Fiance Visa Question

Hi everyone, this is my first time in a forum :) Here's my story..

- I have a boyfriend, we started our relationship in 2003.

- I came here in the US in 2007 as a Permanent Resident.

- I went back to the Philippines December 11, 2010 to January 1, 2011

- I am about to take oath for US Citizenship on July 31 and want to file a petition

I am planning to file a petition for him as my fiance come August. I am aware that one requirement is that we meet in person within the last two years prior beginning the K-1 Visa.

Would it be safe to apply the fiance visa as early as August knowing that the 2 years minimum requirement that we should meet is just 4 months away?

We are trying to cut back on our expenses since we are planning to get married after the visa has been approved and the cost of the plane ticket is very expensive.

Please advise. Thank you so much for your time :)

You need to meet WITHIN the last 2 years. So if you file in August, you need to have seen him in person between August 2010 and August 2012. That is all you need to do for that requirement.

How about the form G325A, i can fill it out my self but do I need to send it to him to be signed and dated? Then eventually send it back to me to complete the application?

He will need to sign and date both the G-325A and the letter of intent to marry for the petition. He will also need to send you a 5x5 (cm) passport style photo for the G-325A...unless you already have one.

Letter of intent, is it a letter addressed to USCIS just stating that he is to marry me within 90 days after the visa has granted? How about me, do i need to do the letter too?

He needs to state that he is legally able to marry, and intends to marry you within 90 days of his arrival to the US

My fiance and I last seen each other feb of 2011. He took his oath for US citizenship Feb of this year and filed a K1 petition on the same month. Now we had our case approved and waiting for a case number.

About the form G325-A. Yes he has to sign it then send it back to you. He might want to just download a G325-A form on the web so you guys can save the cost of having those documents go back and forth. Just make sure he downloads the current one and not the older version.. About the letter of intent, we haven't sent one but luckily we got approved without an RFE. But you might also want to submit those just to be on the safe side. Nobody wants to have an RFE anyway. Good luck! :)

Both of you should make a signed letter of intent to marry on your own writings. :) I think you can have it typed and printed though, but I read on posts that its better to be handwritten. hehe. :)

Aloha! You dont have to send him the form.. he can download it himself or just email the form to him and then he can type in the information, and then print it.. then sign and dated.. thats just what we did.... as well us the letter of intent. just follow the sample letter. let him print it just change the names and then sign.. Tell him to gather all the forms or requirements he or she needs before sending it in mail. That way you can save money in sending mails.. :-)
