Consulates handle these issues. They may lend him the money for a flight home. Usually they will need to see an itinerary.

However, even though your marriage might be failing, you still have children over here that might be better off with you in the country. I don't know your situation so I can't really afford to judge your reasoning for leaving, except I hope you think long and hard about leaving when there are children involved, especially because you have not filed AOS which means you have an overstay. An overstay is forgiven when you're the spouse of a USC but ONLY if that spouse petitions for you, and if you're having problems and thinking of divorce, it's going to be a while before you can set foot in the US again. THat's one thing, the other is seeing your kids. Your wife will have to agree that they can come see you in the UK, otherwise you will not have the option of visiting, nor having your kids visit you in the UK in the near future.

Nice. I found the movie on Netflix and watching it now on my iPhone.

Its a GREAT movie. If you're a parent the next video in the series is called Courageous. That's a great movie for parents as well. Both of them have mad an impact in my life! Either way, OP, good luck. Be cautious in making this decision and please weigh all possible options before making one. Look at the pros and cons. I know you will do the right thing. Just please don't anything irrational. Praying for you, OP!

Usually if you wish to return to the "home country" you can go to an Embassy or Consulate for your country and get a ticket home in return for surrendering your passport. So once you are back in the UK you are stuck there until you pay for the flight back and get your passport back. Check with the consulate though, I am not sure about all 199 countries, just the ones I dealt with when I worked in an Embassy.

05-31-2011 - RFE requested. They want better passport pictures of me.

02-21-2012 - AOS interview approved. EAD/AP card confiscated.

John don't call immigration because if ICE comes to deport you man you MAY spend months waiting to be deported. I don't know if you are victim of domestic violence, but if you are then seek shelter in a safe place(shelter for victims of domestic violence) or call some charities (catholic etc...) and they may help you buying the ticket.If you need to find some shelter to stay send me a private message.I wish you the best and hang in there man,a brighter day will come.

back to the OP ...

Coupla things....

1. remember there are 'safe harbour' cities that don't care about your immigration status. try to find one, within a 3 hour drive of your children's mother's domicile.

2. if you meet the age requirements, Mr. Obama has a quasi-amnesty program that you can file for - you get a year green card and *BOOM* suddenly you are legal in the USA. You can legally work, and do other stuff.

A lot of you seem to be missing the MAJOR point. HE CANNOT WORK! He arrived legally but has been out of status for over 4 years. In order to AOS he should file the I-130 and I-485 which costs $1490. He has already stated he cannot afford it at this time. He cannot file for VAWA because as stated their relationship is simply failing, there is no abuse. He has no grounds to file for AOS unless he files with his wife which he cannot afford to do. He also does NOT want to stay in the relationship so staying in the relationship just to get a greencard would be fraud.

It sucks that they had kids together with him being out of status. He doesn't really have many options at all. Personally though I would stay in the US until court documents have been filed pertaining to custody, bearing in mind that they might not award anything to do with the children visiting internationally. It's a hard decision to make.

He can try, sure. He should wait to assess his options but only because it's "so soon". So many people are sitting around waiting for immigration reform. With kids he's an ideal candidate to do the waiting. But he might not WANT to. he's probably in a fair bit of emotional pain at the moment. Anger and just wanting to run away.

Forget the Hope of Reform. This is going into effect at the End of August, regardless. If he's within age range, and not been arrested, he qualifies.

JohnF, do you have someone in the UK to go home to, somewhere to stay? The reason I ask is, unless you do have somewhere to go home to, you are going to be in no better position than you are in the US. I know you said things are difficult with your wife and you need out, you never said if she was abusive, just that you can't tolerate his behaviour anymore, what is the situation, is she mentally/physically abusive or are you just tired of her. Mate if she is abusive get out, go to a safe house, get help, but do not leave your kids, they need you.

You've been given some excellent advise, people on here really do seem to know their stuff, but ultimately the decision is yours and yours alone, just don't make a hasty decision and end up regretting it later.
