125% poverty guidelines for I864

My sister is the one who sponsor for my husband. She is a self-employed and her income this year is around $16,000.00. On her income tax, she put my brother as her dependent. This means that my husband, brother and I are based on her income as well. So what I need to do to fill in to meet the poverty requirement for this year? I don't know what other asset she needs to put on the form? Although, her previous years income were higher. Please help me in this matter, thanks ahead for the help.

9/17/2011 - sent I-13

09/19/2011 - noa1 received

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

KIDS' CASES

04/20/2012: NOA107/20/2012: instead of an approval, we got thrown into AP. sigh

11/01/2012: Boys' I-130 interview set for November 28, 2012.

11/28/2012: I-130s APPROVED! APPROVED! APPROVED!

12/31/2012: DS-3032 sent

01/08/2013: DS-3032 accepted

01/02/2013: AOS bill0

Well, she didn't list me as her dependent on the income tax return, but doesn't the USCIS assume that she is since she is the joint sponsor for my husband?

Are you saying that the 2011 tax return showed $16K? If so, she can't sponsor anyone.

No you don't count. It's her, the brother ('cause hes on the tax return) and your husband so 3.

nowhere near enough. http://www.uscis.gov/files/form/i-864p.pdf is where the income requirements are. $23,862 is what sshe needs for her household size. Seeing she only earnt $16K if she wants to use assets (bank balance, property etc) then she will need to show five times the missing amount. So she's around $8000 under, $8K x 5 = $40K in assets.

You need to provide your OWN I-864 and supporting documentation.

Hi Vanessa&Tony, thanks for response, so in my sister case with the low income, should I list her house,and life insurance on the asset on her I864? However, she owns the nail shop? should include that as well to help boost up the income asset?? She is the only one i can ask to help for the sponsor. So any suggestion please help. What does she own / have that can be used as an asset? It isn't something that you can add. And her assets would be valued at a 5:1 ratio ($5 asset = $1 income)

No, just because she is sponsoring your husband, doesn't mean you are her dependent as well. You either are or not. In this case, you are not. Her household size would be 3.

It would be difficult for her to use her primary residence as an asset because a forced sale would be a undue burden on her. However, if she has sufficient equity it may be possible. What is the house worth? Anyone else own the house with her? What is any mortgage or loan balance on the house?

she is still single, and my brother is the only that she claimed on her tax return. She owns the nail shop and the house is just only in her name. hopefully these stuff will add up to the requirement income.

Does she own the house free and clear? Or is there a loan? These are important for establishing a value and a home's inclusion as an asset. No room for wishing and hoping here.
