File Returned to USCIS

Timeline

I contacted one of my senator's office last week and today I found out that our file is being sent back to USCIS.The Consular officer says that the relationship was entered soley for immigration. I have only seen him once in 3 years. We are trying to save our money for our future. He had his interview last month and was given a 221G form requesting proof of relationship. He brought hotel receipts, engagment ring receipt,emails, my phone log from my calling card and pictures to the interview. I thought that was enough. In response to the 221G we sent pictures, emails (about 65) , engagment ring receipt (again), envelopes from the mail I sent him.

The only possible red flag I can think of is that I am a lot older than him (about 17 1/2 years) We get along great and the age has never bothered us.

I plan to call USCIS tomorrow or Monday. I also plan on calling my representative in congress. I am doing the right thing by contacting USCIS? I am unsure what to do at this point. I am also considering hiring a lawyer but I thought I would contact USCIS first.

Has anyone else gone through this? What is my best course of action.

Sorry about this, but wasn't getting the visa your future, not spending time with your SO was a hugh mistake. You can try all of the things listed above, but you must overcome the "the relationship was entered soley for immigration" denial.

I have spent time with my fiance. We both have jobs. I tried to get off work to see him in June 2010. That was 6 months after we met. We spent time together in July 2011 and filed for K1 visa August 2011. I took two weeks off work, spent $1600 for an airline ticket. We have been saving money ever since. We can not afford to spend $6000 - $7000 on a vacation more than once a year.

The requirements for a K1 visa state that you have to have met once in the last 2 years. We met that requirement. We sent alot of proof from 2009 - 2012.

Sorry about this, but wasn't getting the visa your future, not spending time with your SO was a hugh mistake. You can try all of the things listed above, but you must overcome the "the relationship was entered soley for immigration" denial.

It appears that you did not file for a K1 visa. Your timeline says I130. The guidelines are different. There are plenty of people on here that have been approved after only meeting once in person.

Maybe you need to read up on the consular reviews for the country your SO is interviweing within to see how they handle limited relationship contacts. I have been on this board long enough to see that one visit in a middle eastern country generally doesn't persuade the CO that the couple has a valid relationship. Again, you can continue down the route you are going, I wish you much success on your journey.

For some countries doing just the minimal just doesn't work.

Maybe you need to read up on the consular reviews for the country your SO is interviweing within to see how they handle limited relationship contacts. I have been on this board long enough to see that one visit in a middle eastern country generally doesn't persuade the CO that the couple has a valid relationship. Again, you can continue down the route you are going, I wish you much success on your journey.

For some countries doing just the minimal just doesn't work.

Meeting within the last two years is one of the MINIMUM requirements for "filing a petition" for a foreign fiance(e). It is not the whole story. Consular officers are expected to and trained to consider the totality of circumstances in making what is ultimately a fairly subjective judgment call about relationships.

I realize you think of the above as "reasons" but for a Consular officer, the above is nothing more than "excuses". Your reverse age difference is a huge red flag for Pakistan or really, any Muslim country. Chances are, the only way you'll ever be successful getting together in the USA is if you go there, marry and spend pretty significant time together living as husband and wife.

The question I asked if anyone else has been through this. I am looking for responses for other people that have gone through this. I have also seen other older women that are discrimanted against at this consulate. It is the old double standard. Older woman younger man. I do know a lot about Turkey. I have been there many times and I am aware of customs. I also read consulate reviews, timelines, and I take everything with a grain of salt on this website.

Thanks for the intelligent reply. My fiance is from Turkey. I am meeting with an expierenced immigration attorney on Wednesday. Any idea how long it will take our file to get back to the United States? It would not be wise for me to live in his village. I do not think they care much for foreigners. I thought we had a lot of proof for our relationship. I will go there and marry him if needed.

I looked for the answer here but could not find the answer. Does anyone know how long it takes a petion to be returned to the United States from the Embassy. I called UCIS and they do not have it. They told me I had to wait 120 days. Does that mean it takes 120 days for the file to be returned or do they have 120 days to review it?

It is 120 to 180 days for them to review it. Depending on the consulate it may take between a month to 3 months to return it to USCIS.

Well, officers in Ankara are very well known with Turkish values and culture.I am sure you understand what I mean.Big age difference is questionable if lady is older than guy.However,if you can prove genuine relationship it will work.Do you have any primary evidence like Flight confirmation,boarding pass? pics,Ring receipt,phone calls and emails worth nothing if there is no primary evidence.
