RFE taxes 2011

Well we don't have any W2 as we were not in the States but I will e file and would love to send copies of everything. I really don't want to wait for the transcript cause I know it will be a while.

Did you efilled? We're you able to get complete copy yourself or did you have to go to the IRS?

Efile works but I wouldn't suggest you do by yourself. Do you have a h&r block in your area? Take the forms you have with overseas income and they will file for you. I really don't know how it works with overseas income. How did you know his overseas income satisfied the income requirement for USCIS?

For sure I will have a professional doing it for me.

I know his income satisfied the requirement as 2012 year.

Unless you have very complicated taxes, there's no reason you can't do it yourself, online. I like taxact.com, it's usually free. A "tax professional" will just charge you to input information into the computer and print a form. You can do it online, e-file and print. Then you sign, copy and mail. You should also have something similar to a W-2, if you don't have one. Do you have some sort of document stating his income for the year?

In any case, before you go pay money to someone else to do what you can do yourself, why don't you just try it? It doesn't cost anything to create an account at taxact or turbotax and put in your information. They only charge you if you file with them.

Oh, and I sent copies of my most recent tax return and have not received an RFE.

After reading again the all instructions for the I 864 here is what I found

If you were required to file a Federal income tax return during any of the previous three years but did not do so, you must file any and all late returns with IRs and attach an IRS generated tax return transcript documenting your late filling before submitting the I 864 Affidavit do support.

So this is my case exept that I didn't do it before...submitting the I. 864

I will have to wait for the transcript.

Especially that I don,t have any W2 but only French income papers, which will not help but just make the situation more complicated!!!!

Luckily for me they are just asking for 2011......

I see, so you should have filed joint taxes. Now you have to file late, and if you file late they want transcripts. Makes sense, I guess.

If it were me, I'd file 2011 ASAP since that's what they are asking for, but then go ahead and file 2010 and 2009 too, just in case you're asked about it. But, I tend to overdo things.

Well they only ask about 2011. So my tax men just finished it and told me that he was not able to e file!!

So it will take 6 to 8 weeks to process and after that I will be able to get the transcript directly at my local IRS. Probably in September!!!

I am thinking to include the letter from USCIS for IRS and explaining to them that I am in a rush cause without that my application will not move and I won't be able to get my EAD....

Any advise on that?!?!

Did he tell you why he can't e-file? From what I know, e-file is available even for late filers.

Yes he did. He's been doing taxes all his live so I guess he should know.

It is because I have to file 2555 EZ for foreign income since we were abroad.....

87 days for RFE starting July 13th....

I just did a quick check and you can efile on taxact.com if you use the 2555, they don't support the 2555ez. Some other sites might, I don't know. It's rare for anyone to be excluded from e-filing. If I were you, I'd take the paper return from your tax person and go to turbotax or taxact and start plugging in the numbers. Foreign income goes under "other income", I believe. You could be done in less than an hour.

If you really believe you can't efile, then you have to mail it and hope they process it fast enough for you to respond to your RFE. I don't think there's a way to expedite your tax return, but I could be wrong. Getting the actual transcript, once your return has been processed, only takes about 5 days.

Apparently they support both forms directly on the web site from IRS, will try it as soon as T get my info from my tax men! He mailed it today should get it in 2 days hopefully!

You are right it is free file alliance and I fund few others than takes 2555 EZ. Will try once I get my info from my tax man by mail!
