New member. My USC mother in law petitioned for my wife ( her stepdaughter) and me in 2003. We were married by then but with no children. Since then we've had two sons. The petition was approved and sent to NVC in september of 2009. A couple of days ago we we askes to fill out the choice ov agent form since our case is likely to be current in nine months. How, if necessary do we add our two sons to the application?

You and your kids are eligible as derivatives of the petition your mother in-law submitted for your wife. When your wife submits her DS-230 visa application, you and your kids submits yours as well, along with the required fees.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Thank you. Do we do that before the interview?

Yes. Submit the DS-230's to the NVC at the same time with the same fees.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
