Hello VJ community,

We need some advice and help about what order to file AOS/EAD/AP and SSN.

After talking it over with my fiancee, we have decided to get married soon after POE (probably within 2-3 days of her entering the country) so we can get the clock started on the AOS/EAD/AP especially on the EAD/AP because my fiancee has expressed interest in working as soon as possible and attending her brother's graduation in the spring (March/April) if possible.

We anticipate her arrival to be October/November if all goes well with the rest of the K1 process.

So should we file AOS/EAD/AP before SSN? SSN before AOS/EAD/AP as suggested in K1 guide? or can I even file both at the same time since we are early in the 90 day window? Are there pros and cons of filing one before the other? The only thing we know is that the marriage will take place first.

We are planning on following the sequence as described in the VJ guide. It seems to have worked quite well enough for prior VJ members. We don't feel the need to re-invent the wheel, if you get my meaning... :blink:

Just get married within 3 months once she gets here. for SSN, you have to apply before her visa expires (make sure she stay here for 10 days before applying for SSN) once the visa expires, you have to apply for EAD/AOS in able to get SSN. The 90 day window will expire once you get married. You can apply for EAD/AOS anytime.

It doesn't really matter which way you do it in your case. She won't be able to request a SSN until at least 2 weeks after entry, and then a couple of weeks after that (sometimes longer) she will get the number in the mail. If you are planning to get married 2-3 days after arrival and then immediately apply for AOS/EAD/AP, it won't be possible to get the SSN first. THe AOS application form asks for a SSN but it's not essential - if she doesn't have it yet she just leaves that blank.

Check to see if your state needs a SSN from both parties to get a marriage license. If so then she will have to apply for and wait for the SSN first.

If you get married, apply for AOS/EAD/AP, then go to the SSA office two weeks after her entry, she will get the SSN shortly after, then once she gets the EAD/AP about 2-3 months after applying she will be good to start work and travel.

Thank you for confirming my suspicion of going this route. :) We will get married, file the AOS/EAD/AP and then go to SSA office two after her entry. Best thing also we don't have to deal with the name change either.

Applying for a SSN seems to be a ####### shoot depending on the educational level of your local office. Applying for a SSN in the maiden name has problems, Applying for a SSN in the married name has problems. Neither should as per the SSA website. For the SSN you should wait about 10 days to make certain your wife is entered into the SAVE database. If they cannot find her then take your application and leave and return another day to try again. You have until about two weeks before your I-94 expires to apply. If you enter that window or your I-94 expires it takes an EAD or GC to get a SSN. I would recommend you take notes when you go to the local SSA office so you can send an e-mail to the man SSA e-mail address to get help should the local office give you any problems--note date, time, location and person or persons you talk to and what they tell you.

You can apply for AOS without a SSN. Not sure what the pros and cons are other than you do not have to wait on the SSA for the SSN before applying for AOS. We had the SSN before applying to AOS so we included that number on the AOS application--just another number tying all her files together.

My wife and I got married 5 weeks after her arrival. We waited for the marriage certificate, took about two weeks before we could get certified copies, and then went and got her SSN in her married name and a State ID. We had the SS card in hand before she filed the AOS/EAD/AP applications. The marriage certificates in my state have both the before and after marriage names, so it makes proving she's the same person and that is her legal name now a whole lot easier than some other states.
