I need help big time this is confusing.. So i came to the US with a Tourist visa (B1/B2) in 96' (i was 6yrs old). I married my husband last year have two kids together. We have already sent I-130 and G325A ( sent on June 18th received receipt letter 2 weeks later). Have already received the NOA and right now im just waiting. I had a gut feeling and decided to research which i shouldve done before :/... But through this website they have told me and read to send in the I-485 and I-765 ASAP because i needed to have filed for AOS so the process is faster and get my residency sooner... Now im on track and now were to be but i have these questions before i send the applications in :

I have checked http://www.visajourn...tent/i130guide2 and it says to send in

1. I-130 So i have already sent I-130 and G-325a... They told me to just send a copy o the NOA but do i resend all of the documents required or just the copy?

2. G-325a do i have to resend an additional passport pics or i dont have to since i already sent them?

3. I-864 Do i have to send the I-864? Im not sure what it is for and if i qualify... ( My husband (USC) is the only one working since i dont have a ss and im able to stay home with my kids. He has a stable job has been at this job for 6 months already but its permanent for know ( he wants to enroll in college once we get my ss and i can start working to help out). My husbands boss is very nice he gets payed $375 a week and an apartment and all bills included are with his pay. All we pay for is our truck,cellphone, school loan,insurance etc. but no household bills.

4. I-485 I know we deff. have to send the I-485 which is $1070 $85 biometrics are included and if I-765 is sent together there is no fee correct?

5. I-765 (optional) I know i need to send this :)

6. I-131 (optional)I believe i dont have to send this correct?

7. G-1145 (optional) What is this exactly?

Now when i check the I-485 package list i need these:

G-325A filled out, signed and dated. ( i sent this with the I-130 do i have to resend??? and the passport pics?)

12. I-693 Do i have to send this?

13. I-864 Do i have to send this?

14. I-765 I know i have to send this :)

15. I-131 I believe i dont have to send this correct?

16. I-485 Supplement A I believe i dont have to send this correct?

17. I-601 I believe i dont have to send this correct?

Background Info.

07/14/12- STILL WAITING HAVENT RECEIVED ANYTHING

THE BEST advice ANYONE can give you is...go to www.uscis.gov click on the forms tab top left corner. then scroll down to find the i-485 form...click on download INSTRUCTIONS...read those instructions as they are very self explanitory. DO NOT let people tell you what forms to send etc...it will get too confusing. seriously, read the instructions and do what they say. and yes, download the instructions to the i-765 and i-864 and follow them to the T. any other forms you are concerned about, again, find the form on that list and download the instructions and read. other people will confuse you with what forms you may need etc. if you cant figure out something specific on a specific form, research it and lastly ask someone. dont forget you can ALWAYS make an appointment at an infopass center. thats also found on the left hand side of the uscis.gov websit. the people there are immigration officers and obviously will steer you in the right direction. calling the 1-800 number is almost useless in my experience. take my advice, read the instructions. it is the ONLY 100% accurate information you can get online. dont get me wrong, lots of people can give you helpful advice but it could get very confusing. www.uscis.gov - forms tab - download instructions from WHATEVER form u want to know about and read. :)

1. You do not have to re-send the I-130 package, just the NOA you received. USCIS will match the two packages together once the I-485 arrives, so that your case becomes concurrent.

2. You have to treat the I-485 as the I-130 didn't exist. It will ask for several copies and docs you may have already sent with the I-130, but you'll need to still include and send them again with the I-485.

3. You definitely should re-read the forms, instructions and the VJ guide for AOS. I-864, which is the financial affidavit, is most definitely required. It is mandatory for all intending immigrants. Basically, your husband has to show that he is able to provide for you and your family to prevent you from becoming a public charge while in the US. If his income doesn't qualify him to be a sponsor alone, you can get a co-sponsor. If you have a family of four (you, him, two kids) then he has to earn at least $28,812 per year. Based on the weekly income you mentioned, he currently only makes around 50% of that, which means you will have to get a co-sponsor. Read the instructions for the form carefully, it explains with detail who can be a co-sponsor and what they need to file.

4. Correct. No fee for I-765 or I-131 when sent with the I-485.

5. You seem to be on top of this one.

6. Because you have overstayed notably, it is advisably for you not to plan any international trips until you have the actual GC, so the I-131 is pointless to you in that case. Recently there has been discussions of previous overstay not resulting in a ban when an AOS applicant travels with an AP, but I wouldn't risk it. Better to not travel until you have the actual greencard.

7. G-1145 is exactly what the form title says - E-notification form. You can send it along with the other papers to receive email and/or text message notifications about your case status and situation. It's not the most reliable system, but it's still good to fill it out. You'll get the info faster that way then by just relying on the letters USCIS sends.

In regards to the I-485, as mentioned earlier: YES, you have to send everything that is listed in the instructions, including documents you have already sent with the I-130.

I-693 is the medical. It is mandatory. This is also explained in the instructions. You have to make an appointment with a certified civil surgeon to get the medical done and forms filled out. Depending on your vaccination records, you may have to get vaccinations too. The list of civil surgeons can be found on the USCIS site with a zip code search.

All the other forms were already adressed earlier.

The VJ guide, and the instructions for the I-485, are up to date. Don't question them too much.. whatever is listed there, is required. If something isn't clear, then ask for more help, but make sure you have everything together before sending anything out -sending out an incomplete package will only end up delaying and complicating your case.

Thank you so much for your answers i really appreciate it :)

I have another question for the I-864 i know i need a co-sponsor and the only person that comes to mind that makes more then 28,000 is my father in law. He said he is willing to help but he is already a co-sponsor for his sister and he is not sure if he can be my co-sponsor as well??

I need a response ASAP thank you in advance and appreciate your help very much :)

Yes he can, but he must count the previous immigrant he sponsored in his family size to determine the amount of annual income he needs to make to qualify as sponsor.
