Hi, I came to US on H1B visa recently with my employer (IT services firm) as the petitioner (did not come to US for a specific customer). After coming here, I have been working for one of our client for the last one month. I came to know that my employer must procure an LCA before I start working for the client. My employer will procure LCA next week. Since there is already a delay of one month in procuring LCA, I am nervous as to what could be the implications for me? Could they be as extreme as sending me back to India or just penalize the employer? Please help. Thanks.

Worst scenario. I don't think they will send cops to deport you immediately. Most likely, they will give you a notice prior deportation. You need to leave by this date xx.

Then, if you don't, you will get those so called bars. It means you are banned from entering United States for a certain period.

There is nothing to lose. Don't get nervous, you will still live with or without the job. It is frustrating to think about it. But that is life. Leave the rest to God as long as you have done what you could do.

I can't help you but my best bet will be visiting an immigration lawyer. You will get a better answer than just going to a forum.

Don't get me wrong. Forum is free, and there are many people who might have the same experience as you do now. However, you need that IMMEDIATE assistance before they do something nasty to you. You do not want that.
