Intention to cancel H1B

Hello,

I got my h1b 2013 approved, and it has not been effective yet. I recently got a job offer in Asia. I am no longer interested in working in the United States.

Should I tell USCIS to cancel my H1B? I also have i-130 F4 on file. Would it have a negative impact towards my interview for i-130 in the future?

Thanks.

The 2013 year starts 1st October 2012, weird as it may sound.

Government speak?

Just when the Visa year starts, I do not know why.

Boiler is correct. My h1b will start this october 2012 which is considered to be h1b 2013 =/

Question: I will be going back for business trip during the end of September.

Is it too risky to get the stamp from my home country?

Not trying to confuse anyone. I still have my options here. This is the worst scenario that I back up the job offer in Asia. I still have my job here.

If someone can help me, I will really appreciate.

I have US degree from accredited university and it's pretty well known.

What risk do you see?

I think you trying to keep all the options open, for you to go for H1 stamping you will have to accept the offer in US join the company and you would need the documentation and the current pay stubs for stamping.

There is not really any risk other than that, but if you never accept the offer or resign from company in US than your H1 becomes invalid anyways.

Thank you. I'm currently on OPT. I'm waiting my h1b to be valid on this coming october.

The company refuses to pay me prevailing wage, and my h1b is not full time. It's part time.

Will I have trouble showing my current pay stubs at my home's US embassy?

They need to pay your prevailing wages and provide full time employment for you/job to qualify for a H1b.

Has to be full-time position, just wondering how did they process your H1 with part time or not giving you prevailing wage.

Unless your company provided fradulent documents with the application.

Becareful of such companies before you accept their offer.
