Hi! I just want to have an idea how long is the processing of I-130 if I petition my son. He is 16 yrs old living in the Philippines. Is it faster for a US Citizen to petition than a GC holder?

Thanks. Will appreciate all your input.

Not sure of the timeframe for Phillipines, but it is definitely faster for the USC to petition.

It takes about 6-12 months for a US citizen to petition for an unmarried child under age 21.

When your son enters the US on the immigrant visa, he will automatically become a US citizen for meeting all the requirements of the Child Citizenship Act. He can apply for a US passport as proof of his US citizenship.

Aside from my son's birth certificate & my proof of citizenship, what other documents should I submit? Should I also submit tax return documents? I'm confuse with others saying they were required to file I-864. Do i also have to file this together with I-130? Thanks so much for all your response.

Not with the I-130. I'm confuse with others saying they were required to file I-864. Do i also have to file this together with I-130? After the I-130 is approved in the next 5-8 months, the NVC will contact you about paying the I-864 fee, filing the I-864, and your tax returns. Thanks so much for all your response.

You file the I-130 first. Then you wait about 5-8 months for USCIS to approve the I-130. Then, you pay the I-864 fee and DS-230 fee. You submit your tax returns with the I-864.

if you are GC holder.. 2 1/2 years waiting petition become current

if you are citizen.. would take a year at least for his/her to come to the US

if you didn't apply yet (citizenship) why don't u go ahead file I-130 at the same time then when u become US citizen.. call them up(USCIS) upgrade your status while I-130 is on process..
