Krikit its wonderful that you have found someone to share your love... I am always happy to see someone be happy again after the death of a spouse...

I agree that there is a place for a prenup.. I just think things like that should be discussed in full and agreements got when you are at the begining of planning your future together... I feel it was a bit unfair to just announce a few weeks before the wedding that he wanted a prenup... and then to be all hurt because she was a bit taken aback and got upset... I just know how lost and alone I would feel if my husband had changed his mind and left me to defend and provide for myself and child in the USA....

Have any of you ever lived with a person who likes to spring 'big' stuff on you at inopportune times?

I have. It's not pretty. It catches you off guard and makes you feel blindsided.

To me it doesn't matter that it happens to be a prenuptial agreement. It's just that it was 'a big thing' and 'big things' shouldn't be left to last. Which - no matter how you slice it - was what happened here.

In any case you should pay for the ticket (and prehaps more) to send the woman and child home, if you are not going to find a way to resolve your differences. Even if you believe that she is a "gold-digger". There is a little girl that was counting on your love and support and I can't see how she could be anything but innocent. I would help the 11 year old girl even if my "mistaken love" was a ax-murder. The child has much invested in this relationship so much neither you or your "was to be fiancee" could never repay her enough.

It is a shame that the child can't sue for damages because the girl has suffered at your hands (and prehaps the mothers hands as well) You really owe this girl something more than just support until the flight home. You should make things as comforable as possible and pay for the tickets home (at least).

You cannot tell me that the girl has not lost much from this process. You knew the potential cost when you started this love match.

By the way, I did get a prenump myself. I talked about it months before my wife came to the USA and it is now just a worthless piece of paper. I would give her anything she wanted. (unless she was a ax-murder - then I would give all to her daughter-- no I mean MY daughter)

I paid my own way, I would have paid my own way back if it had not worked out.

I did not and do not expect to be kept by my US Spouse, if there was some expectation in this area, I have not seen it mentioned.

I'm just curious as to why all you people are assuming that he is a big bad man? That he wants to put this poor little innocent woman and her daughter out on the street. It's been well documented that foreign do use USC's simply to get into the country. This could be the case here couldn't it? I don't know if it is or isn't. But Geez! Maybe you all personally know the OP. But I don't.

Interesting, I have read the "other stuff" and I do not see where he is a bad guy for wanting to protect what he has earned PRIOR to their evening knowing each other. Whay is ti that because you get married to someone, that you must immediately give up all the assets that you have earned for the many years before you have met???? I just do not get this! Every professional I consulted (lawyers, financial advisors, therapists) before marrying, advised me to get a pre-nuptial. So, why is it so bad???

I don't see how she would be a gold digger, given that she signed it. I don't think it would say she was a gold digger if she didn't want to sign it. I think it's perfectly natural to be surprised at a pre-nup that occurs so late in the relationship (usually they're settled), and I think it's even more natural to be worried if there's a language difference, showing up in a brand new country with very quickly changed expectations, and not having her own lawyer to represent her interests.

If someone says, 'Just sign on the dotted line, sweetie, really, my lawyer says I have your best interests in mind, though you have no job and I own a company', I'm checking to make sure I don't get screwed. If someone says that in a language that isn't my first in a country I don't know with laws I don't understand, I'm probably not going to cheerfully say 'Okay!', especially if it's never been brought up before I moved halfway around the world.

If the U.S. petitioner wants the K-1 holder to leave (his/her household) before the the 90-day period, is the U.S. petitioner required by law to support the K-1 holder for the remainder of the 90 day period until they must leave the country?
