Hi,

I'm new here. I am from a VWP country but I violated the program rules (I truly regret the thoughtless decision) and as a result I need to apply for visa if I want to go to US. My question is if this revocation of VWP is for the rest of my life or for certain number of years? Someone I know also had his VWP revoked but for 10 years, I believe. But that was over 10 years ago... Also if I receive a passport from another VWP participating country, could I be back on the program with that passport?

Getting a passport means that you are a citizen. Using a second passport could ( probably would) be seen as an attempt to avoid the rules. The ban is against you not your passport. When you apply for ESTA the question is worded "HAVE YOU ... " not has your passport ever..

This will not be over quickly. You will not enjoy this.

I completely agree. ..And I think it's fair despite you might regret what happened. VWP comes with a responsibility. It's the country that's a part of the visa waiver program and that has been "pre-approved", not the individual.

You might run into trouble when presenting your info at POE if you have nothing to hide and you're truthful. Country of birth is usually marked on a passport as far as I remember? CBP has the right to question you about it if they think it is suspecious that you're using one passport over the other.

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

In general, you can never use the VWP program again, and will need to apply for a tourist visa.

You could always try ESTA once in a while. If you can afford $14 now and then, there's no harm in filling it out as long as you answer every question honestly; Lying on an ESTA form could cause trouble when applying for a tourist visa. Don't be surprised to get "Travel Authorization Denied" or "Pending" then denied, but if ESTA mysteriously comes back "Approved" you could certainly try to enter, although CBP may have some questions too. Getting a new passport will not help, as the VWP ban follows you, not your passport. It's like a traffic ticket, it doesn't go away simply because you renewed your driver's license.

What was your violation? Depending on your current situation and if the violation wasn't "too serious" I don't see why you wouldn't be able to get a tourist visa in not too long. I personally know people who overstayed the VWP by a few days and had no problems getting a B-2 later.

Agree 100%. The VWP is based on reciprocal trust between countries, and "risk assessment" based on low overstay/violation rates. If you violate the terms of the VWP, you don't just violate the privilege of traveling visa-free, but you also help bring up your country's overstay/violation rate.

In addition to the comments of all others, the nature and gravity of your violation will dictate what your possibilities are. You will need a visa to return to the US for sure, so depending on what happened you may have more or less difficulty getting one, if you qualify.

Apply for a visa, tell the officers the truth and good luck.
