need help to bring my spouse with commen law marraige from Egypt to the states

i am married from 3 years in Egypt and my wife had a green card and she applied for US citizen ship end of 2009 and she got it on May 2010. during the fulfillment of the paper she didn't mention that she is married as we found it will be easier for her during the interview.

any way last year in Apr2011 we went to the states and she delivered our baby boy in RI.

so both of them now has american citizen now except me.

Now how can i obtain green card though marriage, and if we need to get married first in the states.or mentioned that we are married as commen in law marriage.

also for ur information i have a tourist visa (B1/B2) valid for 5 years. but we are living here in egypt and not planing to move to the states unless i have a green card for granted.\

So basically you are stating here that she lied on her application back then about her marital status to avoid any possible hassles regarding her green card? :huh:

And we wonder why we get questioned so intently sometimes..... :whistle:

How did your wife obtain her green card?

A common law marriage is not a legal marriage. Were you married LEGALLY at the time she filed for US citizenship? This is very important. Are you LEGALLY married now?

I think the OP means civil as opposed to religious marriage.

Common-law marriage is recognized by the US for immigration purposes if the marriage is also recognized in the country where it took place, and if the couple have the same rights as any other married couple in that country. In lieu of a marriage certificate, USCIS would usually want to see some proof that the government of the country where the marriage took place has recognized the marriage.

Can you prove that the government of Egypt recognizes your common-law marriage, and that you have the same rights as any other married couple? If not then just go ahead and get married in Egypt. You don't have to marry in the US in order to be eligible for a spousal visa. The US will recognize an Egyptian marriage.

Please explain precisely what you mean by this.
