AOS from J1 VIE french program

Bonjour a tous,

Je voudrais savoir si l'un ou l'une d'entre vous s'etait marie aux USA avec un(e) citoyen(ne) Americain(e) pendant le VIE? Ou connaissez-vous quelqu'un qui l'aurait fait?

Je me suis marie il y a trois semaines, et je suis pret a envoyer tous les documents necessaires a mon Ajustement Of Status (AOS). Je ne suis pas sujet a la regle des 2 ans (certains J1 le sont), cependant il me semble que le VIE pourrait etre considere comme "subventionne" par l'Etat Francais… Ce qui rendrait sujet a la regle des 2 ans tous les detenteurs de visa J1 sous VIE aux USA (c'est a dire avoir a quitter les USA et retourner en France deux ans minimum avant de pouvoir revenir sur le sol americain)…

Bref, si quelqu'un peut m'aider a y voir plus clair, ce serait vraiment sympa!

(Je sais qu'il existe une solution pour savoir si oui ou non quelqu'un est sujet a cette regle des 2 ans, mais la procedure prend de 6 a 8 semaines, et mon visa n'est plus valable que pour 6 semaines aujourd'hui… Ce qui me rendrait illegal avant meme de recevoir une reponse de l'administration americaine)

Did you mean "absolument" litteraly (answering my main question), or was it just because my post was in french?

The above post is asking about whether or not her J-1 visa from the VIE program in France is subject to the 2-year HRR and whether or not she can file AOS based on marriage to a USC.

It will say on your visa and your visa paperwork if you are subject to the 2-year Home Residency Requirement or not. I wouldn't count on the list of applicable fields, but rather on your visa paperwork. Does your visa, visa stamp, or visa paperwork (some DS forms I believe) say "Not subject the the 2-year HRR" or does it say "subject to the 2-year HRR"?

Hi, my j1, as well as my DS2019, say I'm NOT subject to the two year rule. But my contract is special, and I basically just need to know that one french guy/girl managed to switch from J1 (VIE program) to AOS, or H1B, etc. without having to leave the US. That would prove that these contracts are not considerd as subsidized by the French government. And that I can 100% trust what's written on my visa and DS2019.

If your docs say you are not subject to the 2-year HRR, I wouldn't waste energy searching for something else. You have all you need. The visa and paperwork itself trumps any special "list" you may find. I doubt many people on this forum have been in the exact program as you, but maybe someone will come along.
