Hi there! this is a very very weird time that I am asking if I might be able to get an RFE. I am on my 3rd month of waiting, now is not really the perfect time to analyze things. Anyway, I went through the RFE thread and was reading all about the proof of meeting for the past two years. my fiance and I met 4 years ago during medical school. all we sent was just pictures from 2008 till now. I was reading that pictures are not enough as primiary evidence. Should we have included his passport stamps dated 2007 when he went to the Phil?

next. I read over the checklist of the I129F before sending this package. we sent the Certificate of Naturalization only and the first page of his passport? is that enough or the BC should also come with them

I saw this on the checklist and it was all OR. On the day of sending the package I slipped the 1st page of his passport because I was not contented of sending just the Cert.of Naturalization..

Omg im sooo lost. the agony of waiting is hard already, now its the thinking that will bother me post. your advice and comments are highly appreciated.

As far as your petition is concerned USCIS is only interested in the 24 months leading up to your submission. Did the evidence you sent prove that the petitioner and the beneficiary had met, IN PERSON, in that 24 month period? If it did you should not get an RFE. If it seems unclear to the adjudicator they will request further evidence.

The naturalization certificate should be enough (did you copy both sides?). If you are going to send a copy of the passport it needs to have a validity of at least 5 years and you need to send all pages.

Good luck!

Doesn't seems like you have any proof meeting in last 2 years. You would need passport stamps, boarding passes, hotel receipts, etc... showing seeing each other since 2010. If you haven't submitted it, you will get an RFE, if you don't have it then it is a bigger issue, as they will not approve petition without meeting in last 24 month, while there is a waiver available, it is usually pretty hard to get thru.

So most likeley you will get an RFE for that. As far as naturalization certificate you probably will be fine, I only send the front, and never got an RFE.

Good luck on your journey.

hi thank you for your reply. that was my biggest problem since we only collect pcitures not the receipts etc. but I sent the pictures dated 2008 up to now. we were always together in school and we had stated that in our statement of meeting.

I don't know if the back side of the naturalization certificate is critical, I only ask because the VJ guides sayspecificallyy to send both sides. If you were to get an RFE for that it would be an easy fix.

If the photographs establish the two of you in each others presence within the past two years you should be fine. If you are concerned that they may ask for more evidence start looking around for any documents that tie you two to the same place at the same time. School records?

we have school records but we didnt send it. ill be prepared just in case an rfe will appear. i thought the pictures would speak for themselves because it really showed the thin and thick of us through medical school.

did you date the pictures on the back?? this is a requirement, if you did then it would be obvious the pictures are not valid because they do not meet the requirements.

It's difficult to second guess what a USCIS adjudicator is going to do because they've made some decisions that have surprised many of us before. However, generally speaking, photos are considered secondary evidence. They usually aren't considered sufficient proof by themselves. Photos are usually entirely produced by the petitioner and/or beneficiary rather than an unbiased third party, and they contain images of people and other content that the adjudicator would not recognize and cannot verify. In other words, photos are easy to fake, and an adjudicator might have a difficult time recognizing that they're faked.

They usually require some primary evidence - something produced by an unbiased and reliable third party, and which the adjudicator can recognize and verify. They like to see passport pages with entry/exit stamps, stamped visas, and airline boarding passes. Adjudicators see these documents every day, they know what they're supposed to look like, and they can usually recognize if they've been faked or altered. If you don't have these then a statement by the school might be sufficient, if it's written on the school's letterhead stationary and signed by an administrator.

If you didn't include evidence that you met in person within the two year period prior to the filing, then the petition will be denied....no RFE. You NEED to have met, and prove it, within two years prior to filing. If you met in person four years ago and never since,...then your first order of business is meet in person again....THEN file again (with another filing fee included).
