AOS in US without visa...

although, i guess i do now because i filed the i-485 as a spouse of a us citizen. and there is no visa limit for this class. so i do have a visa then? just not in my hand/passport so to speak

I-485 is for adjust of status

you don't get any visa, you are adjusting your status from a visitor to a permanent resident

A visa is a permission for someone who try to enter this country, since you already here you don't need any kind of visa for now

I also just want to mention that you should not leave the US until your I-485 is approved and you have the green card in hand. It's not a problem that you overstayed, but if you leave the country, it becomes a problem (you'll activate a 3 or 10 year ban depending on overstay length). My wife overstayed about 3 years and was approved without issue, but they asked us 3 times in the interview if she ever went back to Canada during those 3 years (luckily, she hadn't despite our ignorance of immigration laws at the time). ya i knew that already but ty much! i see lots of people getting their "gc's " in 3 to 4 months. and then others in a year or two. i guess i just want to know when to expect it. its been an unusually long wait if u look at my timeline. i havent recieved my bio apt. letter yet either sigh... im just impatient and as u can imagine BORED.

As posted above, you may not have an actual visa but as a Canadian you will be treated as if you have a B-2 (visitor's) visa.

If you had filed your I-485 concurrently with the I-130 (which is the preferred way to do it) you would have had your green card in hand months ago.

understood about the visa thing. ty. and as for the gc in hand, I know, im soooooo mad at myself for not digging deep enough and researching enough. but i guess its not like someone walks up to you and tells u how to apply for an aos and all that good stuff. and ya maybe i could had spoken to someone but who? and i could have talked to a laywer but i had and still have no money. anyways. i wish i could know a date as to whenn ill have it in hand or atleast when the interview will be lol. patience is a virtue. sigh

Select the local office that holds jurisdiction over your residence (and if you aren't sure just plug your zip code into the tool at the bottom of this page and it will tell you) and see what their current I-485 processing times are.

Most offices are taking approximately 4 months to process I-485 applications.

I think that is being a little hopeful. It appears it is a little more than that right now. Especially if your case gets transferred to CSC. They are running at about 6+months right now. With Obama's new initiative, it appears that some of that workload is "cutting" in line in front of AOS based on Family. I sure hope it is more like 4 months. That would be awesome..!!!

alright, now with the interview when it happens....we have thousands of pictures...and dont really want to print them off..can we just bring our laptop with all of them on it as apposed to spending TONS of money to have them printed on paper?

You do not need to print thousands of photos, I would suggest some photos that highlight your relationship eg. your wedding day. We brought about 10 photos in total and did fine. I saw other with 3-4 huge albums I'm not sure that it makes that much of a difference. I would stick to 20 or so if you really feel you need to do it. You can get photos printed at local drug store or Target, costs about 10cents each, will not need to break the bank.

hrmmm well, our situation is a little different...we have NO current lease agreements, NO bank account with both our names on it cause the bank simply wont allow it until i have a green card or EAD card, we have very few resources to show were legitimate. we have a few things and literally thousands of pictures so thats why i thought it would be a good idea to just bring the laptop with ALL the pictures on it. i would say the BEST piece of evidence we have is our new born daughter and the pictures lol im probably just being obsessive about all this but it seems as tho im not the only one lol

Typically, no electronic devices are allowed. I think the main reason for that is that they do not want anyone to film or record anything

You don't need thousands. It is more advantageous to have pictures that obviously show you together, but also, paint a timeline, photos with other people in them, photos of any vacations together or personal getaways, and photos of the wedding, reception, and family members.
