K1 - will get married on the last 2days stay in US, is it ok?

Hi Everyone. My fiance and I are planning to get married on my 88th day stay in US because we are still waiting and doing some stuff and it need to be done before our marriage. Is there will be a problem if we do that on the last 2 days of my stay and is it ok if i'll get my SSN after i get married?

Yes, and yes. It is ok, but you can get your SSN 10-14 days after entry, married yet or not. http://www.visajourney.com/content/ssn

You won't be able to get it right after marrying as your I-94 will be expired.

As long as the date on the marriage certificate is before the expiration date on the I-94 you will be okay. You will now have to wait until you receive the EAD or GC before applying for a SSC. I am going to assume that you will file AOS in your married name so you can get your SSC in your married name--you do not need a SSN to file AOS.

strongly not recommended. you will have to file for adjustment of status BEFORE your K1 visa expired. If you got married 2 days before your visa is expired, you will have to at least 3 days until your marriage is recorded and you can order a certified marriage certificate to be attached to your i485 application, and the application needs to be accepted by USCIS before your visa expired.

As for SSN, better apply now when your visa is still valid, and later after you got married you can report for name change. later after you received your greencard, you need to report your new status too. good luck !

How about simply applying for SSN in maiden name before getting married, and then changing it when you get the EAD/greencard? Some states will allow you to get a state ID when having an SSN. Great to not drag around your passport. Both SSN and the DMV check your immigration status and won't issue you anything 14 days prior to the 90 days.

Anywho, you're free to get married within the 90 days,k 1st day or last day. I wouldn't recommend the last few days in case something goes wrong and you got married after the 90 days. AOS will be denied that way. The only way to get around that would be filing i-130 and i-485 which is more money and you're guarenteed to have an interview.

AOS doesn't have to be filed within 90 days of POE though. Anything beyond the 90 days(overstay) is forgiven as the spouse of a US citizen.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

The K-1 visa becomes null and void once used to enter the US. You are only required to marry within the 90 days after you enter. There is no such requirement or deadline for filing the I-485 to adjust status.

This is not correct :bonk: the K-1 visa was invalid after the POE and you can file your AOS at any time after the wedding!!!!!!

Good advice!

Our plan is that she and her son will be arriving on 26 July, drop off the luggage (and kitchen sink :lol: ), head to the courthouse and purchase the marriage license (there is a 3-day waiting period in WA state). We then have an appointment on 30 July at the Seattle Municipal Court with a judge, and have the ceremony. Very simple, very private, and I have a few surprises for her, too...... We will deal with her SSN application later on in the first week, and get the AOS process started, i.e., finding a reasonable civil surgeon, etc. I am still trying to figure out the steps involved with obtaining a WA state ID card...... :wacko:

The plan for her son is a little different, we will have to file his AOS paperwork, and then will wait for his EAD, then apply for his SSN. At least, that is according to the limited info on K-2 and SSN applications that I have been able to gleen. Though I am wondering if there is a better way to do the SSN app for the stepson. Any pearls of wisdom would be appreciated.... Eventually, we are going to get him enrolled in a local community college.

Our main concern is to get them here (obviously) and not exceed the 90 day window. It sounds like the typical government slowdown has hit the service centers. So, we figure, the sooner we get the paperwork filed....the sooner it will get processed.....eventually. Hey, like many of us, I swear that it is like watching paint dry or watching grass grow. Anyway, it is all good!!! :dance: :dance:
