Hello.

I brought my wife here on a k1. We got married after one month and then filled out i485-adjustment of status. I am at the university and have a crappy part time job, in other words not enough income myself to avoid the i864. My mother filled out i864, affidavit of support. We all live together in a home that is nearly paid for and that my father plans to leave to me in the coming weeks. The next part is where I need help and rather urgently. My mother recently lost her job which means that her i864 is no longer relevant. I called uscis today and they told me her unemployment benefits are not eligible. So basically what I am asking is, what can I do in this situation? I am not sure I will be able to find any other family members to fill out an i864. I do not want to leave the university and find a full time job. Can a non family member fill out an i864 for us if we find one? The thing is we have no bills and earn enough for food so there is never any risk of us becoming a public charge. Can her father in Germany fill something out saying he will send her money if she needs it? If I need to, as a last resort, I am willing to sell my home. Is there a rule that if you have enough in your bank account you dont need any i864?

Her biometric appointment is this friday so we are moving along quickly and we just want to get this over with so she can start working. Friends, can you think of any advice or ideas? Do you have any insight into this problem? I have not officially reported this to the uscis yet. Anything help will be appreciated.

IF you have already submitted it, there is a possibility you won't have an interview and it will be approved with the previous I864.

You need 3x the amount in bank accounts to make up for it. You can add a home as an asset but it income comes first

Who said you had to report it? At the time of the filing it was accurate.

Okay so it's not your home yet so your father could sign an I-864A to combine his income with yours and use his home as assets.

My mother recently lost her job which means that her i864 is no longer relevant. I called uscis today and they told me her unemployment benefits are not eligible. So basically what I am asking is, what can I do in this situation? I am not sure I will be able to find any other family members to fill out an i864. I do not want to leave the university and find a full time job. Can a non family member fill out an i864 for us if we find one? Doesn't matter who it is as long as they're an LPR or USC

Can her father in Germany fill something out saying he will send her money if she needs it? Not unless he's an LPR or USC

If I need to, as a last resort, I am willing to sell my home. Is there a rule that if you have enough in your bank account you dont need any i864? It's not your home yet. USCIS is unlikely to trust the money you get from the sale of your parents house because it's not in your name so it will just look like your family is loaning you the money only to pass the requirements

This is standard to have biometrics quickly (around a month) and then you'll be waiting another 4+ months given current timelines

I wouldn't discount your mother as a co-sponsor at this point. There is NO requirement to advise USCIS of the change unless you have an interview. So give her a chance to get a new job and see where you stand.

If your case is transferred to the CSC, then you may not have an interview and could be approved with the I-864 situation you already sent in.

If you do want to get a new joint sponsor lined up in case you have an interview and need to present the new evidence, then it does not need to be family. It can be any US citizen or legal permanent resident that is residing anywhere in the US.

You can use assets to make up a shortcoming in income, or assets alone. You need 3 times the amount in assets that you would need in income. So, if you want to use assets alone. For a household of 2, you would need a bare minimum of $56,736 in assets.

Well when you say if it gets transferred to the CSC there may not be an interview what does that mean?

Is CSC California Service Center? Awhile ago we got a letter saying our case was transferred to there to speed up processing.

Will they call the job listed on the i864 during their research and make sure the info is valid do you know?

Most cases that are transferred to the California Service Center(CSC) usually do not have an interview.

The letter of employment and recent pay stubs you send in as proof of your current income is generally sufficient. I do not think they call everyone's employer to verify.
