I'm currently waiting for my EAD and Greencard having applied in May and have my biometrics appointments next Tuesday. MY I-94 is expired now but I do have my SSN. I notice some states issue drivers licences when an EAD is issued. Is this the case with Washington state or will I have to wait on my greencard? I've tried looking at their DMV website but cannot make sense of it. Completely fed up having to carry my passport around everywhere to buy alcohol.

I believe you can use your EAD when you get it. This page lists I-766(which is an EAD) under the stand alone proof of identity documents: http://www.dol.wa.gov/driverslicense/idproof.html

Since I did have a look at this when I was in US last time (I'm assuming you are talking about Washington state and not DC). All you need is a your SSN, proof of WA resident and you are good to go. You can either apply for a permit or full license. If you already drive then I would recommend go into the licensing office and present your documents and sit for the theory exam, once done book a practice test straight afterwards. If you have an international driving license then rent a car for a day with full insurance and do the test. They just need the insurance details with your name so make sure you are covered. If you already have a car then you ask your current insurer to add you into your partners insurance stating that you will be sitting the driving test within 30 days. Normally they wont add you with international licnese but they can with a limit of 30 days with this condition.

I actually tried without an SSN and nearly got through the door but the issue was if you don't have an SSN then there is a way around it. They will register you and send you a letter to your resident Washington address, once you get the letter you need to come back and get through short interview to validate your residency and that is basically show your letter and proof of address. And I told them that my I-130 is in process and they were not concerned about the immigration and wanted to establish the identity and address proof.

If you want more information check the website - http://www.dol.wa.gov/driverslicense/18over.html

theory exam is easy, just read their guide from http://www.dol.wa.gov/driverslicense/guide.html

Hope this helps and ease up on buying alcohol :)

Your foreign passport will do fine.

You don't need SSN for washington state. But you do need a permanent resident address, which can be bank statement or utility bill for that address.
