Filing i485 without i94 or visa number

So my visa and expired passport is still with an ice attorney.. We have been trying to recover it for 2 months but are getting nowhere. Lawyer says its close I impossible to get it back. So I am filing for a new passport but obviously won't have the i94 or copy of visa that are inside the confiscated passport. What do I do?

I do have my old I-120, it's also stamped at the top with that 'd/s' thing from when I last entered the us.. Could I use that for proof instead?

I'm confused - why are you having trouble getting your passport back? Who exactly has it?

As per the op, an ICE attorney has it in their possession.

I would suggest posting over at http://immigrate2us.net/forum/content.php they generally know more about ICE-related matters than here.

Sorry, I am not that familiar with ICE procedures so I guess the part that confused me was why you aren't able to get it back from them. Hopefully Immigrate2US will offer more info and advice on your situation.

We're you in removal proceedings? If yes, you will have to go to court. The immigration judge would approve your I-485 and not an IO. So I wouldn't worry about all that too much. Also your school should have copies of your passport, visa, I-94. You should check with them and see if you can get copies. But I wouldn't worry too much about the documents that ICE took... My friend was in similar situation and got his Greencard

I was but the proceedings were all canceledso the I-485 is being processed normally now.. My lawyer has said its almost impossible to get back the passport. You're right about school though thanks! Although they oby have a copy of my original i94, I left the country on vacation when studying so had a new one.
