My wife and I got married and we submitted our application for her to adjust her status. We had submitted all the required paperwork in April. Regarding her I-485, we had got a RFE letter saying they needed more documents so we submitted that in mid to late may. Last update of our I-485 was on June 4, saying they had received it. We still have not heard any updates yet....but we did receive my wife's new dual employment and travel card in the mail. Should we be worried?

Also, my wife is planning on going to Korea to visit her family for a month or two, should she go? She does have her travel card but since no decision on her i-485 application, will there be problems if she did travel?

I really appreciate anyone's comments and advice. Thank you.

I do not know if you have done any of the following yet, but you should do so to help obtain more data on your application process:

1. Register online at the USCIS website to get most up to date info on your application(s)

2. Call the USCIS application "customer" or applicant support line for any updates etc. I've got through to a human being in as little as five minutes, but it may take up to half an hour.

3. If you are near a local USCIS office you can use INFOPASS to schedule an appointment. I've been able to get in within a few days to talk to someone who can review and advise etc.

I'm not an attorney and not even very familiar with this process but until you get very clear information I would caution the non-USC against making ANY travel plans outside the country.

She has her AP and can leave and return to the US. The only thing would be if her GC is denied while she is outside the US, she would not be able to re-entry. She would have to return for the interview as it is most likely you will have one so keep that in mind when making travel plans--so the possibility of her GC being denied is slim.

Before making any travel plans, make sure your wife has not accumulated any overstay prior to her NOA1.

Day_01 05/05 AOS Package delivered (I-130,I-485,I-765).

Day_31 06/05 Biometrics done.

Day_46 06/20 Interview Notification

Day_79 07/23 Interview. Approved.

Day_86 07/30 Received GC and EAD

The possibility of her application being denied while she is abroad is non-existent, because you will have a mandatory AOS interview before a decision can be made. As pointed out by previous posters, if she has not overstayed before filing for AOS, she can travel with the AP, but she has to be able to return for the interview once you get the date. Also, maybe keep the trip a bit shorter than 2 months with a pending AOS.. but other than that, she's fine to travel. You just have to make sure you are checking the mail religiously and she has to make sure she can and will return for the interview.

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

Thank you everyone for the great answers.

Prior to us submitting her application and her receiving her travel card, she has not traveled outside of the US.

I guess we are going to have to wait because it seems we are risking it. I did not know the interview was mandatory. It cannot be rescheduled correct?

It can be rescheduled, but IT'S still mandatory,

not appear at the interview means you abandon your application which leads to denial

I suggest your wife just wait since you applied at April and your interview notice can be here anytime from now..
