I know #4 sounds ridiculous, but a low-income VJ'er actually asked a Manila consular officer to marry him and his fiancée right then and there if he was not going to approve their visa. The consular officer approved them on the spot. The moral of the story is that a personal plea can be strong medicine.

You know, if worse comes to worse, and the consular officer won't approve your visa, he will give you one year to submit proof of adequate income. That amount of time may give your fiancé time to graduate and get a better job.

Hello sorry for the late response, I have no idea how to check when someone responds to my post(s) (hence my Junior Status ;) OK so to clarify the useage on I-864(Petitioner Only)+I-864A(for Each Person who can help the household member that live UNDER the SAME ROOF as the PETITIONER). The idea is to combine incomes for willing household members who become legally bound to obtain or surpass the minimum 125% poverty level for the number of individuals under the same roof.

If you have co/joint sponsor who live outside the residence then I assume you follow the I-134/I-184 combination that I see people posting about, but I can't speak on that option since I'm personally doing the I-864 + I-864A route. When co/joint sponsorship is being considered, the relationship to the Primary sponsor seems to be one of the more important factors. Family members(Parents/Siblings/etc.) are more likely to be accepted than lets say friends or employers, since they seem to have more invested into the situation.

The The I-864 is a document that NEEDS to be submitted for Adjustment of Status(AOS) once the Petitioner and Benificiary are married. The I-864 and I-864A are legally binding documents that will be used to make sure the benificiary doesn't become a public charge.

Hello sorry for the late response, I have no idea how to check when someone responds to my post(s) (hence my Junior Status ;) OK so to clarify the useage on I-864(Petitioner Only)+I-864A(for Each Person who can help the household member that live UNDER the SAME ROOF as the PETITIONER). The idea is to combine incomes for willing household members who become legally bound to obtain or surpass the minimum 125% poverty level for the number of individuals under the same roof.

If you have co/joint sponsor who live outside the residence then I assume you follow the I-134/I-184 combination that I see people posting about, but I can't speak on that option since I'm personally doing the I-864 + I-864A route. When co/joint sponsorship is being considered, the relationship to the Primary sponsor seems to be one of the more important factors. Family members(Parents/Siblings/etc.) are more likely to be accepted than lets say friends or employers, since they seem to have more invested into the situation.

The The I-864 is a document that NEEDS to be submitted for Adjustment of Status(AOS) once the Petitioner and Benificiary are married. The I-864 and I-864A are legally binding documents that will be used to make sure the benificiary doesn't become a public charge.

Hello YourHumboldtBud! My fiance lives with his mom and I will be living there too with his family, so does that mean we should do the I-864 + I-864A route? But isn't it the I-134 that the consul will be looking for on the interview?

You know, if worse comes to worse, and the consular officer won't approve your visa, he will give you one year to submit proof of adequate income. That amount of time may give your fiancé time to graduate and get a better job.

From the different stories I read here in VJ about this case, I think it is really consul dependent. So I pray that our case be handled by a good one and better be prepared for whatever will be the decision. I feel excited and at the same time, nervous! But thanks to all of you guys for all the inputs, knowing more information makes me feel more confident.

They maybe looking for the I-134 during the interview, but I find it strange how they would accept I-134(which is NOT legally binding) while disregarding I-864 w/I-864A(which IS legally binding). I called the USCIS personally on the issue on and told them the situation about me being currently unemployed, yet living with my family and what would I need to do to show evidence of financial support considering my current situation. I even took down the the person's name/employee#/Date/Time of the call should I run into issues during the interview process. I asked several times to make sure and he stated that I would be using EITHER the I-134 OR I-864 + I-864A(s, which I plan to get NOTARIZED making sure I dot all dots and cross all T's. I was told DO NOT USE I-134 if using I-864 + I-864A(s), and thats straight from the help line at USCIS.

But ultimately I think it will be looked on at a case by case basis. I can only hope that I will get a CO who can look at my situation and make an informed decision based on what s/he is willing to look at. If I wasn't laid off, the amount I was making would've been easy enough to make over the 125% poverty limit, but I've also got my family willing to be joint sponsor, friends and local filipino community backing us to provide support and help where needed.

I guess it's better to err on the side of caution and be over-prepared than underprepared I'll be filling out a I-134 and have it in reserve should the C/O be adamant to accepting the I-864 = I-864A us providing the document, but I know that using I-134 would show that I would be below the 125% poverty level. If the C/O decides to deny our visa on that basis then I'm willing to marry my fiancee in PI and go the Spousal Visa route if needed, which is my Plan B. Only so much can be done in regards to the process, so it's really going to be up to the C/O to decide the outcome, I just hope they can see how serious and how much I love my fiancee, but trust me I'll do everything in my power whatever it takes to be with my fiancee. I've worked too hard put in so much time and money into this, just be prepared with a contingency plan.

Thank you, DJ. We will do the same, just have everything ready. I will have my fiance fill out both the I-134 and I-864 and from his mom the I-864 and I-864A. My fiance too is working hard for this and will fly all the way back here to the Philippines and attend my interview. I really hope too that they see how we seriously take this matter. I'm wishing everyone a successful journey, specially those who really are in-love like us =]

Guys, I forgot to tell you that my fiance is a freelancer. He is not an employee. His pay stubs from his school only says he's receiving financial aid and the other job is drawing images for an online traning (e-learning) which pays him higher than the school job. What will we need to present on the interview? Thank you so much! =]
