my mum is a permanent resident since december 2006 ( she petition for us since feb 2007 under f2b). I strongly believe we're going to be current withing a year and a half. since then she has been going and coming back to nigeria, but she spends most of her time here in nigeria due to her family/biz here in nigeria. The problem now is dat the last time she travelled to US she was given a note that shows a complaints about her long stay outside of US and again '' 11 months outside'' was written with a pen on 1 of d pages of her pp. She is plannin to go back in december, am just curious to knw if there's anything we can do, i dont want to lose all these years waiting.

How long will she have been out of the country when she returns in December?

Her long trips are raising flags, you cannot go back and erase the past

you will not get any visa in the next 3 years .. i'm unsure where the info and idea came from.

The current cut off date IS june 22, 2004 in the last 1 year they moved 11 months. The visa cut off for Aug. 2011 was July 3, 2003. the year prior ..2001.

There is nothing you can do if your mom, the petitioner keeps going back for extended stays. She could spend less time away from the u.s.a to try and create a path to try and fix it.

If mom loses her GC then your petition is void. It sounds like mom needs to live in the US primarily.

Your mother could comply with the requirements for her green card by living permanently in the US.

Also, to petition for you, she will need to file an I-864 along with three years of tax returns. Her Nigerian income is taxable in the US. There will be a conflict when she shows she was not living in the US in accordance with her green card status and living in Nigeria where she was earning a living.

You and your mom have big problems. She need to use her green card for the purpose for which is was granted - to live in the US. Not live in Nigeria and using the green card to bring you over.

Agreed with Aaron. Fortunately for you, you've got 3+ years to go so if she lives permanently in the US from now on you may be fine. It sounds like she has already been warned, though, so if she goes back in December for a long period of time and/or without proof that she actually resides FT in the US, expect her to lose her green card at that point and you to lose your petition. A GC is for a person to reside permanently in the US, not visit.

Just short trips. I hope she has been back awhile. They really watch this. She needs to be very mindful of her stays now. She has alerted the authorities and they ain't playin no more.

As other members mentioned, the purpose of GC is to stay permanently in US, meaning that you should stay most of the year inside rather than outside. However, it is ok to have short trips as long as you don't violate the "permanent resident" definition. I have heard that the maximum allowed time for being out of the country is 6 months in a year and anytime above that will raise flags that the GC holder has not chosen US as their permanent home. However, you shouldn't interpret this as going back and forth every 6 months as this is again going to raise flags. Of course, other members will correct me if I am wrong.

One thing that your mom could consider, is getting something called White Passport or leave of absence permission or something like these :D I don't know the name to be honest. This is a permission to leave the country for 2 years. Again, I don't know the effect of this in your visa process, as it has an adverse effect in citizenship process, meaning that those 2 years would not be counted towards the 5 year citizenship requirement. I am really sorry about these may be wrong information, and ask other members with experience in this regard to correct me ;)

Why did she apply for permanent residence in the USA if she doesn't need or want it? B1/B2 visas are quite adequate for short term sight-seeing and other leisure activities visits. The 'Permanent' in Legal Permanent Resident is just that - PERMANENT, literally.

She should be making short term visits to Nigeria, not living in Nigeria and making short visits into the US yo avoid losing her GC.
