Hello,

I have a question regarding sponsoring my mother for a permanent residence in USA.

I am a US citizen and she is a Canadian Citizen.

I am in the process of filling out the form I-130, and am debating whether I should have her come over and apply for her as being in the US(and do an adjustment of status) or if I should apply for her as being in Canada. What are the pros and cons for each? Which one is quicker?

I would greatly appreciate any advice on the above.

Also, if I do apply for her as being in the US, what is the correct response to question 14 in the form I-130, i.e. 'She arrived in the US as:' . The reason for this question is that she doesn't get a status or anything when she enters the US as a Canadian.

Entering the US without an immigrant visa with the intent of immigrating is a crime and could lead to a life time ban. The right way is to file a petition.

If your mother is older you may be required to show insurance as she will not be eligble for many of the items older people commonly get here after a lifetime of paying into the system. The insurance if you are asked for it can run several thousand a month. Does your mother intend on giving up her Canadian residence ?

This will not be over quickly. You will not enjoy this.

My mother isn't all that old. She visits us frequently at the moment. I am trying to make arrangements for her to stay for longer periods of time.

I didn't think she would be required to give up her Canadian Citizenship.

As a green card holder, she would never be required to give up her Canadian citizenship. She can keep her Canadian citizenship for the rest of her life.

However as a green card holder, she is required to make the US her permanent home. she will be required to file US tax returns on both her earnings in the US and Canada.

As a Canadian she can enter and stay in the US for up to six months. Lots of snowbirds in San Diego every winter.

Get her a green card if she intends to live in the US. Don't get it as a convenience for her to visit.
