I have been reading different comments that relate to the AOS process in relation to change of name. Could someone confirm that you can use your married name on the AOS Application (marriage certificate attached of course) or do you have to use the name on the K1 Visa Application? I assume you can use your married name but would like to confirm that is correct.

Whatever name you put on the application is what the GC will have as its name (within reason of course). So you can enter your married name and the GC will be issued in your married name or you can enter your maiden name and the GC will be in your maiden name. One thing to note is that you will still purchase airline tickets and other international travel documents in the name that is in your passport. If that is your married name then all tickets will be in your married name. If it is still your maiden name then the tickets will need to be in your maiden name until you change the name on your passport. If your GC and pasport have different names you might want to carry a copy of your marriage certificate to help those less educated understand that you are married and both names relate to you.

The only thing the K1 visa has to to with your AOS is that it's based on the approved petition. You also changed adress since the K1.

You have to use your legal last name on the AOS forms(just like you did prior). If you went ahead and took your spouse's name at marriage, then change it on all forms regarding AOS. If you chose to keep your maiden name, then file in your maiden name.

Your (certified copy of)marriage certificate is proof of legal name change.

I took my husband's last name. I submitted 3 cert. copies of marriage certificate - 1 for each the EAD, AP and AOS since they get split up and considered seperate applications when received. At your biometrics appointment, remember to take your certifies copy of marriage certificate if you have filed in married name. My EAD/AP is in married name, and the NOA1s were all in married name.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days
