Timeline

My husband was denied his visa at the interview. Can anyone tell me how long before Islamabad will send our file back to NVC? AND the procedure which will come next? Trying to find all possible information on appeal.

Reason for Denial:: 212(a)(5) (a)

01/03/2012 Sent REF documentation to California Service Center 2079 pages sent to USCIS
01/05/2012 UPDATED CASE STATUS...On January 5, 2012, we received your response to our request for evidence.
02/07/2012 NOA2 I-130 APPROVED

05/12/2012 Medical done in Lahore
06/272012 DENIED AT THE INTERVIEW 212(A)(5a) ***this code is incorrect*** We have no idea why they denied the visa!

08/29/2012 File received back at NVC Embassy and forwarded to CSC
09/10/2012 Received a NOA 1 & Text Message that file was sent to California Service Center where they will make a decision on our case.

05/29/2013 Reaffirmed by USCIS without any appeal process

07/02/2013 The Embassy called my husband for packet 3.

07/11/2013 My husband sent in packed 3

07/17/2013 Embassy refused our case yet again without an Interview and set our file back to NVC

07/20/2013 NVC returned out file to USCIS

09/29/2013 To date USCIS has not entered our case back into the system and no one knows where it is!

212(a)(5) (a) Is usually what they use if they do not believe in the bonafides of your relationship. Is there any red flags in your case such as big age difference recent divorce, previous petitions?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Timeline

No one can tell you how long it will take for your case to get back to NVC. Once it is back at NVC they will log it into the computer and send it to USCIS in California or Vermont where your I-130 petiton was first handled. Then you will wait for the Notice of Intent to Revoke(NOIR). The NOIR will tell you the problems the CO had with your case and you will have 30 days to respond.

My husband was denied his visa also. We received our NOIR and filed our appeal. Our case was reaffirmed and sent back to the embassy. We are waiting now for the embassy to contact us for another interview.

Well my husbands got denied because they wanted more evidence of relationship and they told him to mail every proof to the embassy but they never transfered our case back to nvc we sent in everything the next day and 3 days later the embassy called my husband and told him to mail in his passport because his visa was approved.

Its very unfortunate the departments do this sort of things, Because the actions of a few influence the judgement of individuals that affects the mass amounts of people.

what seems to amaze me is the request to provide proof of a bonified relationship when the couple have KIDS together... i dont know what more proof is needed.... perhaps a video of the creation process ... i dont know! :blink:

06/272012 DENIED AT THE INTERVIEW 212(A)(5)(a) They were pist off due to the fact I sent in 2000+ pages for our REF. Told him they were waiting for him to come in. They gave him all 2000+ pages and told him to take them home.

This is pure curiosity, and I apologize I can't be more helpful, but why did you send in 2000 pages in response to a RFE? This is good to know for the future... Best of luck...

why do i get the feeling they have to electronically keep documents and not physical record?.... i think someone did not want to have to scan 4 REAMS of paper! seriously 2,000 pages of documentation?.... dont you think that was a bit on the excessive side? ... just a little bit?

Can you please elaborate on the law suit, who was your attorney or did you do it yourself ? How long were you in AP ?

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
