Police Certs & Arrests...

Timeline

Hey guys, so here is the dilemna.... My fiance came into the US on a Visa Waiver as he received his police certificate and it was blank. Our understanding was that you had to be arrested 3 times or for crimes of moral turpitude (sp??) to not be able to use the Visa Waiver.

Is this correct? That was our understanding..but now we are worried as my fiance has been arrested for a DUI 10 years ago (DUI not a moral turpitude) but it had not shown up on his police record and it wasn't till now that we realized you had to write in to the specific court to get a certificate from them?

Is this going to cause problems if they notice he has been to the US before but not gotten a visa but he shows him his blank police cert but tells them he has been arrested 10 yrs ago for a DUI?

Feb 8: Received K-1 Visa

April 27: Married!!

May 4: AOS & EAD sent off.

July 28: EAD Card Arrives in Mail!

Aug 23: AOS Interview! APPROVED!!

Aug 30: Welcome to America! letter arrived.

Sept 7: Greencard arrived in the mail!

2009

May: Received Notice about Greencard Expiration end of August

July 15: Sent packet in mail!! (FINALLY!!)

July 16: Packet arrives @ CSC 10:52am Signed by V. Semegi

July 24: Received NOA (posted 7/21)

July 30: Received Bio Appt Letter in Mail

August 20 @ 2pm: Biometrics Appt. –

Sept 12: Approved!! Should be getting card within 60 days..

2011

April 22: Mailing N400 Citizenship packet to Phoenix AZ! (about time!)

April 25 10:37am Phoenix USCIS Lockbox. Signed for by F DOMINGUEZ

April 28 NOA (received in mail May 2)

June 7 Biometrics Appt

July 26 8:10am Interview/Test APPROVED!

Jul 26 Oath Ceremony! Pete is now a US Citizen!

Nevermind...I found out my own answer...actually my fiance had solved it a while back but I guess I never noticed that...so he is probably laughing at me right now..lol

the VWP question Does ask if you have been arrested but for Moral turpitude reasons or for drugs. DUI is not a moral turpitude arrest nor is it a controlled substance. Therefore he answered in all truth.

Hopefully this is all correct.

Any other notions on this?
