Hello VJ's family! We have an interview this coming july 18 in Manila Embassy. I already gathered all the necessary documents that we need in the interview but i just found out that my husband did not file for I-864w for our 5 years old daughter. I read some post here that it is required for a child of a US citizen to file for i-864w to become a US citizen upon entering to the US. Do you think it will cause some delays in releasing of our visa after the interview? Help me please im so confused and dont know what to do..

The I-864w is a waiver (hence the "w") for the Affidavit of Support because the child qualifies for US citizenship upon admission to the US as an LPR. It is not an application for US citizenship. Filing it would not make your daughter a US citizen. It is only a waiver of the Affidavit of Support.

Does your daughter qualify for US citizenship upon admission to the US as an LPR???? Will she meet all the requirementS under the Child Citizenship Act of 2000????

Is one of the biological parent a US citizen? Is the child coming to the US to live with that parent? US citizen step-parent does not count.

My Daughter's father is a naturalized US Citizen. We applied for a CRBA year 2008 but our application was denied because of lacked of physical presence of my husband in the US ( Residency requirements). Is my child valid to claim the citizenship upon entering in the US? Does my husband need to fill up the form i-864w?

Did your husband submit an I-864? If yes, then don't worry about the I-864w. No need for the I-864w (waiver) when he submit an I-864.

Your daughter will automatically become a US citizen whe she enters the US to live with her US citizen father under the Child Citizenship Act of 2000. No need to apply for US citizenship. Good idea to get a US passport for your daughter as proof of her US citizenship after she comes to the US.
