129 criminal history

Under Part C. question #2 it states:

"Three or more convictions for crimes relating to a controlled substance or alcohol not arising from a single act."

I was arrested/charged with DWI but when I went to court the DWI was dismissed and I plead guilty to reckless driving,

does this qualify as a "alcohol related" conviction?

When I search my criminal record online it clearly states the original charge..

Another incident that appears on my record states I was ticketed for no drivers license and small amount of marijuana,

but when I went to court the small amount of marijuana was dismissed and I plead guilty to driving without a license.

Will this be viewed as a conviction "relating" to a controlled substance?

I do have two convictions for underage consumption of alcohol...

Should I include court records with my 129 application either way?

All of this happened at least 9 years ago by the way.

And your VJ handle indicates you haven't learned much in the last decade

Look up the word in a Khmer(Cambodian) dictionary and get back to me.

:ot2:

PS If you dont have access to a Khmer dictionary just send me your bank account details and I can ship one to you ASAP!

Well aside from the fact that it seem like you're a reckless pothead (ahem)...

You probably need to consult a lawyer, as it's not clear since the alcohol and pot charges were dropped, if the other charges are still related. You'd have to guess wrong and have it come back to haunt you.

Also wonder if the underage charges matter now, or if they've been expunged from your record.

But these are things that a good immigration lawyer will know how to handle.

In his defense, Bong is a form of respect for your elders, it is what you would call anybody older than you.

Also, I think if you are upfront with it, state what you stated here, and also being 9 years ago you should be ok, but don't quote me.

Good luck to you.

With drug-related charges and the fact that he's been here for at least nine years, probably not a good idea to use the name BigBong when asking about overcoming the drug issues.

When your name is BigBong and you ask about marijuana charges, people are going to make a fairly reasonable connection.

He didn't say he has been here for 9 years, he said it happenned 9 years ago. But, I do see your point on the name. hahaha

I am not sure what USCIS, NVC, and consular officers can see when they run a record check. I would be forthcoming about all charges, and state that it was nine years ago, and that you want to be honest, even if it doesn't come up on a records check. That way you are covered if a record of the original charges pops up anywhere. You will definitely have a problem if they think there is less disclosure than required.

Just to be safe, you may want to change your VJ handle. There have been some posts on vj that consular officers and others do look at VJ. I presume any CO in Cambodia would know what you mean, but no sense inviting a misunderstanding.
