Not trying to be mean.

How is this different from any other family?

I presume the child is with her parents, so where is the family separation?

Why should having an US citizen child give the parents a "presidential" opportunity to live in the US?

Every other family has to wait until the US citizen child to turn 21 before the child can petition for the foreign parents.

Why should this case be handled differently?

Because I comes before U

Why are they torn up and split apart? Did the toddler stay in America when the parents left? Rest assured, a 3-year-old will have little memory in the future of having had to leave the country she was born in in order to live in the country of her blood at such a young age. I don't see how anyone is being harmed in this situation. It's England, not Syria. No one is in immediate danger, unless there is more to the story.

we are joannes parents, evies grandparents, we are in florida, as is joannes younger sister, so all joannes family is in america.

immigration made a large mistake by saying joanne did not have the masters degree, which she clearly has, joanne is also on a H1B visa, which although is with immigration, its still pending, so rather than risk getting 1 illegal day, they left the country to rely on the system to put things right.

have you ever tried to call immigration to find out the delay on a h1B, which was submitted december 2011.

evie constantly asks to come home, and america is her home, joanne and paul also see america as there home having been here 11 years legally.

if the green card had been issued when it should have been, joanne and paul would be well on there way to being citizens by now.

please dont bring down a persons situation, until you have lived it yourself.

Someone bought the story of if you have a child in the US you can stay. That isn't the case but they have a return path like everyone that has a US born baby has a path to the US. You wait the 21 years for that child to be able to petition you. In the mean time you had best stay on good terms with your child. The child doesn't HAVE to petition for the parents. This is one of the reasons they should end the birthright citizenship. It seems to only create yet another group of people that want to the front of the immigration line for NOT following the rules. If they would only tighten and simply the rules we would get through this so much faster.

the reason i started the petition, the very week that they left, the president was here in orlando on the friday, making a speech about familys not being seperated.

straight after that speech, i wrote the petition, and joanne and paul circulated it.

not sure if any of you realise how close a family we are, we have seen evie nearly every day since she was born.

Be thankful that Evie and her parents can all be together in one place ... I've been waiting on my husband to come home since his interview last June 2011 over a year ago... our daughter has a brain tumor and we are watching her for signs of stroke..not to mention another anniversary is closing in and still not able to celebrate together.... we are still separated still not together in one home and yes trying to get answers for us is next to impossible... so I have been there....and still am.

While the situation they are in is terrible... its not a family separated (family being husband wife and children)

Timeline

There are processes for uniting families, they are slower than slow, So you can petition your daughter and wait until the petition is current. You may have to be a USC if the daughter in married , but once one family member is here that are paths to unite. Someone chose to be the first one to come here, the others have a place in line. No one forced anyoen to choose to be here. Most of us hate the line, but not as much as watching others cut in front of us. Some chose to abuse VWP and pretend they didn't have intent , others just think this forum will be supportive to other schemes to shortcut the system. Many of us wait in line years, or even decades in the case of bringing siblings. Some people get to wait it out in countries similar to the US, they have good water, tranportation, food and electricity. Others wait it out worried about all the those items. Many of can't safely travel to visit our out of the country family. There is a process for you to be together in the US, as long as it may be. If the wait is unbearable you are free to travel and visit or even leave the US behind. Petitions come through this site all the time and over the years I can't remember one that has done anything to improve the speed above to regular and established process.

This will not be over quickly. You will not enjoy this.

What happened sucks, but it sounds like they have a legal path through the h1-b, even if it is taking awhile. Plenty of people are separated from their grandparents. Maybe you could go there in the meantime while this is pending? A better petition might be to have the h1-b case looked at/reopened if they were unfairly denied a green card, not a petition to bring back a toddler who can return whenever she wishes.
