Hi... i was refused a k1 visa 2 years ago due to public charge.

We didn't submit anything else after the interview to overcome the refusal

since the next tax returns of my fiancee was still not enough.

Now, after 2 years, we would like to proceed and submit new papers for the

affidavit of support.

Has anyone been in this situation? I tried to write to the embassy but no reply yet.

It's been 2 weeks now since I emalied them, and I also sent a fax 5 days ago.

You will likely be starting all over again from the beginning. But first, have the USC check to make sure the first petition is expired / withdrawn.

This isn't something the non-citizen can do.

I read this on Vietnam us embassy website. I am not sure though if it is applicable with Philippines.

Section 212(a)(4): This section of the INA prohibits the issuance of a visa to anyone who is likely to become a public charge. In this case, our office will not process this visa application further until or unless the Petitioner’s financial situation improves significantly. Cases refused under Section 212(a)(4) are open for 5 years to submit further documents.

Just an update on my case, I was able to reapply for visa based on my petition 2 years ago.

It was approved, now i'm just waiting for my visa.

Congrats! If it was the sponsor not meeting the income level, then as long as he did the second time around you basically overcome the reason for refusal.

Usually, the NOA2 from the approved i129f petition expires before the 2 years unless the embassy automaticcaly put an extension on, or you asked for them to do so. That's probably what Darnell is referring to when saying it's rare to just pick up where you left off.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days
