I got an RFE for I-864. My wife had just started her full time job so her taxes from the year before did not prove 125% of the poverty guideline. We sent a letter from her employer verifying her annual salary which met the guideline. I guess it wasn't good enough since it did not match her taxes. I found another sponsor though and sent in another I-864. My interview is now set for August 14.

I-864 is most difficult to file form among all the other in AOS package. It's confusing.

If income is above 125% at the time of filing then you should be fine regardless of last years income.

You would do better if you submitted W2 & bank statements (with the deposits of wages) along with the Employer Letter.

Did you do that or did you just submit the employer's verification letter?

Also, is the employer a large , well known company?

Anyway, since you have already submitted a new I-864 you can disregard the above.

Good luck with your interview!

No I didn't submit any additional documents for my wife's I-864. I just submitted a new one and that was it.

Does employee verification letter need to be original copy? My co sponsor got the employment letter from employer which got a stamp saying its a copy. would that work? I am also sending his last 3 years tax return transcript and w2.

I'm not sure. I don't think it has to be, especially if you send his last 3 years tax returns and W-2. In my case, my joint sponsor didn't even turn one in and we never got another RFE.

You have to discuss this with your prospective attorney.
