We are getting ready to send DS-156 and my fiance and I had planned for his almost 17 y.o. son to follow. Do we have to submit a DS-156 (and DS-157) as well?

The problem is the child (and the ex) do not want to be part of the petition and we are unable to get the forms signed by him. Do we just proceed and not include him and petition him as step-son later?

If so, I think I read somewhere that I may need a signed acknowledgement or waiver that I have knowledge of his minor children but I don't remember where I read it from :(. I just don't want to delay this process any longer. I want my fiance here soon. I'm dying to be with him.

Think you have a year for a K2 VISA to follow through. Why, if the ex and the child won't sign or go with it, are you going the extra mile? Even if you get everything done and ready, if he doesn't want to follow your fiance into the US, it would just be wasted effort. Maybe i just read it wrong. Good luck though.

Thanks Ge and Mayyong! I'm going the extra mile because my fiance's son is very important to him and would like to give him the opportunity later on, in case he changes his mind. If he insists he wants to stay where he is (Mexico) then it will be up to him.

Does anyone know about or if there is a letter I need to sign? Or if we can just put to follow and no DS-156 will be expected? Thanks!
