My husband and I are getting ready to send in 1-130. He is disabled but does not receive social security. Basically he has no income.

We met and married 5 yrs ago in Canada where I was working while he stayed home and helped me raise my son.

the question I have is: his mom now supports him since I can't work, if he she claims him as dependant on her taxes will this effect the outcome? She will be his financial support as we live with her and she makes a good living?

What visa are you AOSing from? Are you saying you are presenting in the US? After 5 years marriage it would appear you entered with intent to AOS

We Came to visit 7 months ago, overstayed cuz his mom has alzehiemers (spell check) stage 1.

If she has alzheimers, how likely is it that she will be able to keep working and supporting the whole family? I am not sure if that will be an issue with your AOS or not, but that might be something to consider?

I believe if she is sponsoring you, your child and her current household is herself and her son she will need to make enough for a family of 4 at 125% of the poverty guideline: $28,813.
