Good Afternoon all,

Little bit of background, A friend of mines is in the process of also petitioning her fiance, she is a bit hesitant in petitioning him because she has just found out that the mother of this child decide to file child support on him once she found out he was involved with a foreigner who travels (my friend a usc)she has the I-129F I believe is the form for fiance visa, and the money order ready to mail it out.

questions

will this become an issue where her fiance could get denied for a visa?

Can she petition for his two kids?

Can this situation be consider a "crime" in the eyes of immigration?

If someone can please help me answer her question I will appreciated!

p.s.

All I was able to answer as for as "crimes" that immigration may look at is drug trafficking, killing, etc... I think those could be crimes for a denial of a visa, please correct me if I'm wrong.

1. If he pays child support its not an issue

2. Why would she petition for his 2 kids?? :blink: The mother has to give her permission in order for them to come to the USA unless he has sole custody which is not the case.

3 Why would this be a crime ?? :wacko:

LOL... From what She has told me he is really attached to his kids, so she kind of wanted him to spend time with them every so often then when they can fly in...

As for the crime part, Her family from DR have been brain washing her saying that this is a BIG crime where he wont be lend out the country...

I don't know much about the laws of Dom. Rep. but I suppose that will only harm him if he does NOT pay at all... where he can get arrested? so I've heard.

If he pays his child support it won't matter. She can petition his kids if they marrie before his kids were 18 but they will need the mother's permission.

The only way the child support becomes an issue is if he is really behind, his government may take his passport. No passort= no visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I had her speak to my ain't who is a judge and as per my aunt no harm will be done as long as he pays, also my aunt told her that the only way it will a effect the visa process is if they put what's called an "impedimento de salidas" which means "exit restriction" that's when it will effect the process.

Also as far as he being in a relationship with your friend that won't affect his child support. The child support is based on his income not his wife or partner.

They only do that if he doesnt pay child support but he should be keeping proof of everything he gives her because they can do that before and after he starts the process and the only way they will lift that is if he shows proof that he does provide for the kids
