ok, hopefully someone can help on this question. We were put on AP (visa fiance). I have not heard anything at all and all USCIS is saying is that it is still being reviewed (doubtful). It has been 10 months and nothing. If i need to cancel this petition, how do I go about it. I am in |Morocco as I write this and considering narruage because I think they will let it expire and marriage I hope is the better solution. This is my 4th trip to MOrocco and again, as many of you out there, times you visit obviously does not make it any better. I will have been here 1.5 months already and on my last trip I spend 3 weeks on each trip. NOnetheless I am not doubting it will expire but again, my question is, how do I cancel this petition...

Hey Rose! How's it going in Morocco?

I just wanted to clarify something so you can get better answers from the members here with experience. You are not in AP. Your fiance was given a 221g and the case was sent back. AP is a different situation. I can't answer your questions about what happens next, but I'm sure someone here with experience will chime in and help you out. Good luck. :thumbs:

If you got a 221g notice and your I-129F petition was processed in Vermont, Commonly, your file will not be available for anybody to "find" for about six months or so after the interview. Eventually, USCIS will contact you and do one of three things.

1. Notify you they disagree with the Consulate and are sending the file back for a second interview. (Possible but unlikely)

2. Send you a Notice of Intent to Revoke (NOIR) the petition approval. This is the most likely action. When they do this they give you at least thirty days to respond with additional evidence you would like them to consider.

3. They will simply notify you that the petition approval has expired and do nothing. You are then free to file a new petition.

If they decide to "reaffirm" your petition approval based on your response, they will then send the case back through NVC and on to the Consulate for a second interview. There is no guarantee the visa will be issued at the second interview.

Now is the time to begin getting your NOIR response ready. The first item on your agenda should be a complete and detailed report of the interview experience including all the questions asked and even more important, the answers given. This is not a synopsis or interpretation, but a literal and close as possible verbatim COMPLETE report. From this report, you can get an idea of the problems to address in your NOIR response.

If all this seems to daunting to you, I suggest you seek professional assistance.
