Hello My Visa journey family:) It is been long time since i post on this site,but now i have a questions. We just got married on June 27th,2012 and now it is the time to apply for our AOS. So will you guys tell me if i can apply even if my I-194 is expired? And what forms do i need? Do i need a finger print before a apply for AOS i mean do i need it to apply my AOS?

-Feb.27,2012 NOA2 approval (131 days from NOA1)
-March 7,2012 The Petition Forwarded to Consulates:)
-March 23,2012 Packet 3 and 4 Received.
-April 3,2012 Visa Approved
-April 20,2012 VISA in my Hand.Yey. smile.pngsmile.png
-April 25,2012 My Flight and My POE is JFK
-August 03,2012 AOS filed
-August 28,2012 RFE
-September 05,2012 RFE sent and They received it on Sept.13th
-October 10,2012 EAD approved
-October 18,2012 EAD card in the mail.Yey

-September 6,2013 Green card APPROVED!!!!

Yes, you can apply after the I-94 expiration.

Follow the adjustment of status guide here on VJ (Guides at the top of every page).

There will be more fingerprints needed. You will receive an appointment for these (Biometrics) after the petition is filed.

Hello My Visa journey family:) It is been long time since i post on this site,but now i have a questions. We just got married on June 27th,2012 and now it is the time to apply for our AOS. Just so you know, you are out of status with an expired I-94. What that means is you are accruing over-staty days and should you reach 180 days before filing for AOS/AP/EAD the AP will not be of much use. Also, if you find youself near our southern boarder and get pulled over by a CBP SUV doing random checks (I've been told that you do not have to stop for them but how will you know it is CBP or State Trooper unless you passed them and see the side of the SUV?) and they run your immigration status, you can be detained for the expired I-94 which will be an unpleasant experience. So I would file the I-485, I-765, and I-131 together in a single packet and pay the filing fee for the I-485 (which was $1070 but you should check on that).
