I just thought I would let you all know how it goes when I cross the border with my proof of ties to Canada. I will be entering the US on Monday and will bring the following as proof I will be returning to Canada in my stated time:

1) Current Government Issued Vehicle Registration;

2) Lease Agreement in Alberta for when I return, plus proof that I paid July and August's rent;

3) Employment Verification Letter indicating I have booked a two week vacation and that my employer expects me to return to work on XX/XX/2012;

4) Most Recent Paystub from job;

5) Return Flight Itinerary (already purchased, non-refundable);

6) Rental Car Reservation Confirmation Number to get back from the city that I fly into (when I return to Canada) to the city I will be living in.

FYI - CBP advises that you keep a list of everything that you will be taking over the border plus an estimated market value for such items, and that none of the items are to be the Canadian's; all must belong to the American that is moving. It's difficult to distinguish what is hers from what is mine, since we both own the items equally, being married. I decided that if CBP wants to abide by those rules, that I would have to legally give everything we own to my wife legally so that we wouldn't run into any issues. I will be keeping a list as we pack the UHaul this weekend.

I will keep you all updated on how it goes at the border. You may not hear from me until my wife and I get to Florida on Friday next week. Hopefully everything goes well! Not looking forward to coming back to Canada by myself, but you gotta do what you gotta do, I guess.

Wish me luck!

Best of luck. If I understand this properly---the USA citizen is currently residing in Canada AND now moving back to the USA to start domicile. Keep in mind even with all the proof that the CDN citizen is returning, the USA POE officer does not have to let u gain entry into the USA--in other words, don't loose ur cool and argue,lol Your will never win. But most don't have any issues, but you showing up in a U-haul truck is a different situation. Have a good trip

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I suggest bringing a copy of the NOA1 as well (and maybe a copy of the I-130 petition, if you have it). If needed, it can be proof that both of you are following the legal process of immigration.

Yup. This is true, and I've come to terms with it. I just hope I make a good case for myself and that they like me. I've been to the US hundreds of times, so hopefully they will see my evidence, see that I've never overstayed, and then just let me help my wife move into her new place. Thanks, Flames9_RN.

Totally forgot to put that in my original post. I will be bringing the NOA 1, too.

Good thinking with the I-130. It will show that Montreal is where I am planning to take my interview. I will print out the docs right now.
