Zimmerman was the aggressor because he defied the dispatchers advice and pursued Trayvon Martin. A 17 year old boy running an errand to the grocery store for a snack on the night that it happened to be raining and he just so needed his hoodie up.

Trayon was innocent. Zimmerman was stupid. Now if Zimmerman was black they'd send him to jail for the killing but Zimmerman is half white so he might have a chance with the being stupid plea. Is ignorance defensible? I guess we'll find out what the jury believes. I think in most cases though ignorance seems to be punished with those who have a percentage of minority ethnicity. The black, hispanic, white ratio in the jury may play a key to jury selection here in addition to income level. They're all going to see things differently and the defense wants the kind of jurors that fit the demographic funding Zimmerman's website, bail bond, legal fees, ect. I think historically social media and internet solicitations may play a vital role in the legal ruling of the justice system. It's sort of the first of its kind type situation that I can recall.

Actually proving Zimmerman racially profiled Martin was an important part of the prosecutors case.

The other fact that came out of the recent release is that police whilst confirming the head injuries were divided on whether they thought his nose was broken.

So now, not only is the FBI the final arbiter on the social issue of what constitutes racism, the police are who determines when fractures are present. Got it!

Back to the point. I don't see how it matters whether he is or isn't racist. He's just an idiot, which legally doesn't matter either, but probably is why he's in this mess to begin with.

I think he is more than 'just an idiot'. Idiots are everywhere. Zimmerman is an aggressive idiot with anger management issues and a gun. He is a dangerous idiot at the least!

You can commit the crime of 'assault' with words spoken or with physical actions that do not involve touching. When you touch someone during an assault that is often called 'battery'! Zimmerman quite likely did 'assault' Martin, at least verbally. His credibility to deny it is gone with his demonstrated dishonesty in the court-room. Now he has to hope for sympathetic racists on the jury to keep his sorry a## out of prison!

It is also against the law to say anything or take any action that might cause a reasonable person to feel they are in danger. This is assault. You do NOT have the right to get in someone's face and challenge them on their right to be in a public place UNLESS you are operating within your area of responsibility as an authorized police officer. This is where Zimmerman blew it with tragic results for Martin.

I looked this up on a few law sites and generally the only way to commit assault through verbal actions is if there are other threatening actions as well, like say zimmerman was brandishing a firearm etc.

Well I'm trying to remember if the racial element was what they were using to justify murder two as the lead investigator only ever suggested manslaughter.

A threatening action might be getting right up in someone's face, within inches perhaps and demanding to know what you are doing or just being verbally threatened or harrassed. And it is a good thing that Zimmerman didn't 'brandish' a gun at any point!
