Leaving the U.S. With Expired Passport?

Hello everybody!

My passport expired a couple days ago. I'm in the process of getting a green card and getting a new passport from the consulate here in the U.S. Can I leave the U.S. in this situation?

Unlikely the airline will allow you to board without a valid passport. You'll also need a passport to return

That is theoretically up to the country you're flying to however you probably won't get to board the plane without an unexpired passport. Some countries require the passport to have at least xx months of validity in passport.

You'll have to mention the country destination though, and layovers if there are any in other countries. But I'd still advise you to have an unexpired passport on you before travelling internationally since it's the only form of ID that's accepted worldwide(to my knowledge).

unless you have an AP document, without green card in hand your AOS application will deem to be abandoned after you leave the USA.

There is no outgoing CBP check. You will find out at flight check in if they will let you fly without a valid passport.

I'd suggest you get emergency travel document if available. Your problem isn't only leaving the US. CBP doesn't care however the airline company have to vouch for you when boarding their plane and traveling with them.

When entering anywhere in Europe, the passport is your only internationally or European accepted proof of ID. Not only will you have to ask the airline company, you'll have to ask the POE/airport you're arriving in. And just like when arriving in the US, it's completely up to the officer whether or not they'll let you enter without the passport unless they specifically state in writing that you may enter on an expired passport.

What is your nationality? A European citizen isn't very specific, especially not if you arrive in a different country than your home country - European citizen or not.

with a new passport and the greencard, you can do whatever you want.

make sure the ticket is in passport name, and bring the marriage certificate with you , to show these two names.

You should check with your consulate. Some countries allow their citizens to go back to their home country if their passport expired while they were away. The airline should know as well.

I'm almost sure Argentina lets you do just that, but I don't remember how many days of grace you have.

How long will your passport renewal take? How about bringing proof that it is under process of renewal such as a receipt?
