Hi all

I am a US citizen and my fiance has been granted a K1 Visa. She arrived in the US a few days ago through JFK and had been told during her embassy interview that she would be able to work right away.

However, we have now reviewed the requirements and it appears that this is not the case. Instead, it appears that there are two options available, at least one of which must be satisfied before she can start work: either we get married immediately and she applies for an adjustment of status, which takes around 90 days, or she applies for a EAD, which also takes about 90 days. Is it correct then that there is no way in which she will be able to work immediately?

I have noticed that some people have posted that they were allowed to work immediately upon entry after their passport was stamped at the gate as saying "Employment Authorized" however she was never given this option.

Please let us know your experiences and opinion as to what the quickest option would be to allow her to work in the US.

Cannot work right away on a K1.

Get married, then submit for AOS and include also for EAD and AP (beleive those are free when included with AOS), then wait. Again.

This is one of the reasons why IR1/CR1 visa may be the better choice. You only wait once. I think.

You should marry within 90 days, you can then apply for AOS, Adjustment of staus can take up to or above 8.5 months and cost $1070. The EAD should be approved within 60-65 days. Remember to apply for her SS card she will need that to work with the EAD. You can apply for the EAD separately but thats a waste of money. Good Luck :)

That stamp loophole was closed a couple of years ago. Marry, then adjust status (EAD and Advance Parole can be filed at that time with no added fees). It's going to be a couple/few months before work authorization.
