Hello everyone,

I was looking online for some kind of answer regarding our grand-daughter.

We came in the US under E-2 visa since 1994. By then our daughter was 3 and is now 21 and temporary green card holder when she married her high school sweetheart. From there, our little Phoebe was born on US soil.

Our daughter's husband, unfortunately, left her when she was 6 months pregnant to disappear and never gave sign of life. Disgusted, she applied for divorce and she gave up custody of Phoebe to us, the grand-parents.

Of course, we have now a problem with paper works. Phoebe can go to Belgium, our country of origin, only 90 days. And our E-2 visa has not been renewed.

What are our options here? We'd like to stay in the US because of our business in the US and stay close to our daughter who need us. We can't really go back to Belgium and come back to the US every 3 months because of our grand-daughter.

Anyone knows the best next step for us?

Hello, for your options or lack thereof in the USA, you should ask a good lawyer specialized in immigration matters.

What is the status of your daughter, is she a permanent resident in the US?

Should you need to go back to Belgium, you can request a visa for your granddaughter, some information can be found here : https://dofi.ibz.be/sites/dvzoe/FR/Guidedesprocedures/Pages/Regroupement_familial_avec_un_Belge.aspx.

This board is for Immigration to the US and it looks like your issue is how your adopted Granddaughter will be able to move to Belgium.

Presumably Phoebe is not eligible directly for Citizenship.

I would start with the Consulate. I doubt if there is a Internet Forum?

Where is your daughter now?

Do you have custody of the grandchild, or did you adopt her?

Your grnadchild cannot petition for you. But if your daughter is still in the USA, and a US citizen now, she could petition for you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
