If someone needs a co-sponsor due to lack of income, but the co-sponsor does not make enough to meet the guidelines can the petitioner and the co-sponsor combine there incomes? I said no but my friend is getting different opinions.

I think that if the co-sponsor is a family member in the same household as you, then you can combine your income/assets with theirs with them filling out the i-864a. If not in the same household, it cannot be combined.

I believe that's correct but someone please correct me if I'm wrong.

Household members can combine their income with yours to meet the 125% poverty level using the I-864A,but if not in the same household the joint sponsor must meet the 125% income requirement alone, it means you cannot combine your income with the joint sponsor to meet the income requirement.

Here is my friends situation. She is getting married in January and will file I-130. She does not meet the income guidelines, she also lives with her mom. Combined income they would meet the guidelines they think. She has 3 children. so would the income guidelines since she is living in the house include her 3 children, her mom, herself and her husband= 6?

Seems to me that if they live in the same household, they can join resources.

Yes, must meet 125% of the poverty level for 6 people.

One must pay close attention to what constitutes being a part of the same household. It's more than living at the same address. Also, if the mother meets the income requirement for herself, her own actual dependents and/or spouse plus the intending immigrant, then she would be a "joint sponsor" not a household member. So, for example, if Mom is single her income requirement to sponsor her daughter's son is based on a household of two, not six.
