Use Fiance's Home Country or Resident Country to File?

HI

I have a question, I am getting ready to process the original submission, but we had a thought. My fiance is going to school in another country currently. And we were wondering if it would be best for him to stay and complete the visa process where he is schooling? Or would it be best if he goes home, and processes the k1 visa in his home country?

We were going to have him go home and process there, assuming it would look better that he was filing through his own embassy. But then we are now looking at the option to have him go back and complete the school year, as long as filing in another country grants him equal opportunity. We havent submitted any papers yet.

Thoughts? Experiences?

This will not be a problem...My fiance is from Pakistan, but he moved to United Arab Emirates to work there just so i can sponsor him thru UAE....because he is from pakistan me and my fiance decided to have him go and work in UAE on a work visa, becuz as far as i know its a lot easier there...so wherever you choose to sponsor him is fine there wont be a problem..

what about his address, when you translated the arabic letters as instructed on the forms, did you write the arabic transliteration? (because im assuming mail would arrive best using the arabic words but written in english letters like "mahala, dar, zokak...")

or did you actually translate the words "area, house, suburb... " thanks

Well..my fiance is not arabic so i cant asnwer about that..but addresses should be in english if ur fiance has address that is in arabic than just translate it to english..

We're doing third-country filing as I think it's called, although not for a K1. Generally, as long as a person is legally residing in the country, whether on student or work visa, they're eligible to interview in that country. The only exception is normally for tourist/visitor visas or short-term visit visas. Check with the embassy/consulate where you would plan on interviewing to confirm eligibility.

As far as the current address on forms, we live in Korea, so we used the direct transliteration into Romanized characters but still using the Korean words, including the stuff like "neighborhood", "district", etc. I believe there's a section on the second page of the petition where you must put the current address in the native script, so we also put it completely in Korean there.

Long story short, we have a complicated case. We've been at this for nearly 5 years. You can read our story here. I highly recommend our attorney Laurel Scott, as well as attorneys Laura Fernandez and Lizz Cannon .

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.
