What if we DON'T get approved?

Timeline

Okay, so they have had our petition for almost eight months and we are going insane! I just received letters today, from both my congressman and the USCIS, that they are still waiting on some background checks. That is the most information that I have received in eight months.

Now, I am wondering, what if they do not give us the visa? What can we do? We can not very well live in Jordan, and if the United States will not let him in here....what options do we have? :blink: Neither one of us have relations in other countries to move there....so really! Does anyone know of what we can do? We need all of the advice that we can get because we are both so frustrated at this point and just want to be together!

I know how you feel. It's almost 8 months for me too. I'm not in security checks though, at least they say I'm not. Just "reviewing the merits of the case" What BS!!

What to do if they deny it??

Get to Mexico and pick them up at the border!!!

Gonna try again.

Someone else may know this better than me, but I believe the K-3, spousal visa might be your next best option, but it will depend on the reasons for the K-1 denial.

That happened to us too!!! What we did was we applied again for a K1. Try to apply again since they have new forms and everything and besides from what I see and experienced they are approving petitions within 15 days. Try sending the whole packet again this time with the new forms. Ours was like that no update or whatsoever, what we did when we got back together again was send another petition, that paid off!! we sent it on Aug 1 and by Aug 15 we have our approval already!!!

February 14, 2011 Approved petition from the USCIS (Vermont)
March 02, 2011 Received letter from NVC
March 05, 2011 Payment cleared
March 06, 2011 sent the DS3032 via email to NVC
March 09, 2011 received confirmation regarding the Choice of Agent
March 10, 2011 received the IV Fee invoice via email
March 16. 2011 sent check via USPS
March 18, 2011 received e-mail regarding the IV Fee payment and the package for AOS

There is pretty much only one reason for I-129F petition denial - failure to have met in the previous two years. Not getting the visa is a different story and it would depend on the reasons for the denial. If the visa is denied and there is no way to file a waiver or start over, you could relocate to a third country. I wouldn't start going down that path in your head just yet - you are, for some reason, stuck in background checks but chances are very good that you will get through it!!

Hang tight, YPYSKPY. Eight months is not long ... really. Consider all the checks required and the current backlog and that the U.S. Government is conducting the review. IMO - because your fiance is from Jordon, Homeland Security will double and triple check everything.

My fiance is from Turkey and I anticipate considerable scrutiny before approval is granted. We have nothing to hide. So (for now), I'm content to wait for Homeland Security to check everything to their heart's content.

If your visa petition is denied, you'll be informed of the reason. From there, you can file an appeal and provide evidence which contradicts their assertion(s). Hang in there!

P.S. If you have a little money in bank, fly to Jordan or to a neutral country and spend some time on holiday with him!
