Timeline

I am not sure if i am posting this in the right place. My fiance & I was considering moving to his country & live there for awhile. But I would love for my fiance to be able to come back to the states when i come back. If I marry him there. Will I have to come back to the U.S. & fill out paperwork & stay here until the process is complete or can i do this while I am living abroad with him?

You can do it all while you are living abroad. Thats what me and my wife did. You may even be able to do Direct Consular Filing if they allow it where you live. It just gets expensive because you have to send a lot of stuff in to USCIS and NVC, and it may get tricky if you need to use joint sponsors and stuff like that. Its a pain having to send a document to someone just so they can sign it :/. These were some of the issues that I had. But from what i understand they process the petitions a lot faster if the petitioner is living abroad. I am not positive of this though. Someone can correct me if I am wrong. Our I-130 was forwarded and approved in 16 days.

March 11, 2011 - Met my wife our local tsunami evacuation center due to the tsunami in Japan.

March 12, 2011 - Begin texting back and forth daily.

April 28, 2011 - :D first night with my wife to be. Officially in a relationship.

June 23, 2011 - Formally propose.

July 23, 2011 - Married in Borongan City.

August 28, 2011 - My daughter is conceived (due on June 1, 2012) :D

December 19, 2011 - NOA1

January 5, 2012 - NOA2

March 8, 2012 - Case completed at NVC

March 20, 2012 - First day of med. exam.

March 21, 2012 - SPUTUM

March 29, 2012 - 3 day sputum test NEGATIVE (culture done on May 28th)

May 25, 2012 - Alaysha Elaiah Mae Arma Nichols (MOUTHFULL) is born. 6 lbs. 18.5" and absolutely gorgeous!

June 19, 2012 - Medical Exam Passed!!

June 22, 2012 - CRBA appt. for my baby girl. APPROVED!!! :D

June 26, 2012 - CR1 Visa Interview for my wife. APPROVED!!! :D

July 6, 2012 - Passport and CRBA in hand!

July 12, 2012 - Visa in hand!

July 19, 2012 - POE LAX!!

August 1, 2012 - Green Card Received!

You can most certainly file while living abroad. That it was I am doing from Argentina (We married here as well). Considering all the costs involed in this process a few extra bucks for international postage is not a big deal. DCF (Direct Consular Filing) is much quicker and available for many countries but it varies and in many cases, such as Argentina, DCF requires that the petitioner be a permanent resident of that country, which I am not, never was.

So check with the US embassy where you and yoru fiance are living.

If you file while abroad, but not DCF, you need to maintain/be able to prove your permament domicile is in the US. You need a US address for paperwork. In my case I used my US address for all forms and on the 1-130 I also listed my current, albeit, temporary address in Argentina where it asks for the last address lived togetehr with your spouse.

04-21-2011 Sent I-130

04-26-2011 Delivered 1:35p

04-28-2011 NOA1 E-mail, off to CSC

05-02-2011 NOA1 Hard copy, Priority date 4-28-2001

07-14-2011 NOA2 E-mail

I-130 Approved in 11 weeks!!!:)

***A break from paperwork, not quite ready to move to US, together in Buenos Aires and loving married life:))))

08-01-2011 Case recieved by NVC

04-19-2012 Paid IV and AOS fees online, PROCESSING

04-23-2012 AOS and IV status PAID

07-12-2012 Sent IV packet from Argentina FINALLY:))

07-18-2012 Sent my AOS packet to joint sponsor in US to attach her I-184

07-23-2012 IV Packet arrives at NVC!!!

07-31-2012 Called NVC and received e-mail, IV processed:))

08-07-2012 AOS overnighted via FED EX

08-08-2012 NVC receives AOS

08-14-2012 CASE CLOSED!!!!!!!!!
