Without adoption you would need to go to the court and petition for a name change.

The cost probably depends on the state you are in. Here in Georgia it would cost about $400. It is a simple submission to the court with a reason for the name change.

It's likely that LEGALLY the child's name isn't changed but they are using the same last name as the step-dad. If you're saying they changed the GC they can't just elect to do that. They will need a legal name change for the child 100% of the time either thanks to adoption or a court order.

So if adoption is out then a court order is the route to try. As the child is not your child your wife may need to get the permission of the birth father, I think it depends on state laws and what is on the birth cert.

i really dont know how they did it tho but their kids are using the step dad's last name without having a court or adoption.they said when they file their adjustment they put their husband last name as their kids last name and attach a leter saying they going to adopt the kids soon.i dont know really.i cant get their answer.but see i came her as K3 and they are K1 so i dont know exactly how they filed their adjustment.all i know is i never have a conditional visa.i have 2 years visa and when i adjust my status i automatically get the 10 yrs.

Have you seen the greencards? I'd highly unlikely USCIS changed the last names to the step-dad's last name without adoption or court order forms.
