B2 Denial In Brazil - try again?

VJ Friends... I need your advice and thank you in advance for your time. Chrys (Brazilian) and I prepared and prepared for her B2 interview including my personal financials, statement from work, tax returns, pay stubs, etc. Chrys had my invitation, the letter from me to the Consulate, her letter (on letterhead) from her employer plus her current school (MBA program) records and enrollment schedule and additional supporting documents. The interview lasted less than 2 minutes. Three questions were asked about me in the USA: where did we meet, where will she stay in the USA and what I do for a living. Chrys never had a chance to demonstrate her ties to Brazil, ie employment and MBA program. DENIED. Not enough ties to Brazil. No further comments.

I've spoken with our Visa Specialist in a Federal Senator's office and she said she would send a letter of "request for special consideration" to the consulate prior to her next interview. The Senator's letter would be attached to my letter with Exhibits (Chrys employment letter, education, et al) demonstrating her ties to Brazil. The same documents that were not reviewed nor requested by the interviewer.

I recently returned from Brazil and asked two Brazilians on the flight if they had any issues getting their B2 - both replied 'no problem at all'. Chrys is outside the target demographic - 37 year old female, not 21 year old male. She is a professional school administrator.

- is it worth trying a B2 Visa attempt again?

- does it make a difference with the Senator letter? (only way to get Chrys documents in front of anyone at the consulate)

- I understand her previous denial would be reviewed prior to her new interview appointment.

I'll save the emotional commentary. For now, I'm just looking for seasoned advice from the VJ prime community. Thank you again in advance for your time and thoughts.

It seems in some cases it is up to how the adjucator feels at the time they decide.

Why all the personal info from you? It's not relevant. Could have done more harm than good. The CO likely saw a relationship that they felt was stronger than a job at home.

No further comments.Most denials/approvals are decided for applicants based on what's on their B2 app form so when it's interview time they pretty much get the Yes/No without doing much of an interview

- is it worth trying a B2 Visa attempt again?Yes but give it 6 months to a year and or if she feels an aspect of her situation has changed to work in favour of an approval or if she feels luck is on her side

- does it make a difference with the Senator letter? (only way to get Chrys documents in front of anyone at the consulate)A lot of folks say no (tried and failed) very, very, very few say yes (2 persons actually thought it worked for them)

- I understand her previous denial would be reviewed prior to her new interview appointment. Most definitely

This - when the person being interviewed has a package from someone in the states sponsoring them, many times that is a big red flag to the CO. The visa applicant has to prevail on their own merits. I have gone through the same thing many times with my stepdaughter. She also had letter from our Senator, for whom the embassy said she would get every consideration. At interview time the CO had never seen the letter, and said it wouldn't matter in any case. Less than two minutes disapproval and never looked at the package, and told her he didn't need to. However, I keep spending the money and sending her to the embassy to try.

I completely agree with our seasoned contributors, it seems you focused more on your financial documents over hers.

On top what is the relation, friends, fiancé that would matter too.

Next time focus on more reason why she would return to Brazil coz that is more important.

Many thanks to everyone's quality response. As for my personal financials, just wanted to make a statement to the CO that she has representation and financial means to travel, stay and return. Agreed, post mortem, it was not necessary. Our first time with a consulate and wanted to go over the top in preparation. I wouldn't have mattered if I had DNA samples - it was her burden of proof. Regardless, I share the frustration with everyone who has been denied and those loved ones.

She was more than prepared - letter from employer, letter from MBA program, copies of bills, bank accounts, flew to Recife, did her biologicals the day before, early for interview. CO wasn't interested. Didn't ask for nor request to see. I felt so bad for her because she felt it was her fault.

We've decided to forgo a second attempt and begin the Fiance Visa (perhaps this answers earlier questions). Yes, we are engaged. Since the denial I have traveled to Brazil and she said "OI". God is good and we remain blessed in His eyes.
