Proof for bonafied Marriage

Timeline

I had a love relationship with my GF(USC) for more than 3 year and we finally got married on 07/06/2012 in simple chapel with no witness.But we are not living together as 2 week back she got a temporary job in NY which will go through till October 1st week.Then she will move back with me in Ohio.I am working in Ohio on OPT (H1b filled) as full time employee. Now I am collecting all the documents to file my GC by august 1st week. SO would following documents be enough to show bonefied relationship?

1) we have signed rental lease together on 07/06/2012

2) Added her on my bank account same day.

3) She also got state id for Ohio

4)Added her on my health insurance

5)Telephonic conversation records

6) Multiple picture together since 2009 (but its me and her only in all off them)

7)Pictures of my family and her family get together in my native country.

8) email records since 2009

9) trips records to meet each other since 2009

10)In December we travelling to my country to have a big get together of both the families and relatives.we also gonna perform our marriage again in our religious way.

11)Also her father would be joint sponsoring my GC.

Would it be enough or what else I could add to make my case more strong? Appreciate any advise.

The USCIS understands that newly-weds generally do not have a lot of evidence that shows the co-mingling of lives, it is just the way that it is and so you can only provide what you have and you will always get a chance to submit more documentation at your interview, but here is some evidence to consider adding at some point:

- Joint utilities (water, electricity, cable, trash, cell phone). If you the company won't add both names, then see if you can mix-n-match the names, for example the electricity bill in your name and the cable in your wife's name-- but both with your joint address.

-Credit cards, you can always add an additional user to these.

-401K beneficiaries.

-Medical insurance beneficiaries

-Life insurance

-State ID's/DLs showing the same married name and joint address.

-Wife's passport with new married name.

-Wife's SSN with new married name.

-Savings accounts together

-Boarding passes from vacations together or where you have visited each other. For example, you flying to NYC or her to Ohio.

What you have is fine as is, in my opinion-- but just wanted to throw out some other forms of evidence that may have been overlooked.

Get a life insurance

Get rent receipt

Get junk mails with her name showing the address where you live together and same for you junk mail showing the address where you both live together

Make sure her driver license has the address where you live together and also if she took your last name make sure her license shows her name with your last name

Also make sure she updates her address and name for her social security card ... The address should be where you live together and the new card she recieves should have her new last name showing on it if she took your last name ..

Also have your lease notarized .. It makes it look official

Any utility bill "only if it's not part of lease "

If your utility is party of lease just high-light it on lease with a little note that you do not have any utility bill because it's all covered on lease with rent..

Also any member ship card showing your names on separate card but same member number or policy number

Make sure you have health insurance card in both of your name on same card and or if you both have separate card but showing same policy number and member ID

And you'll be fine.. I did all what I just listed above.. And also I had a company between me and my wife so I showed we owned a company also.. And all was good for me../ I just got approve last week July 3, 2012...

yeah by this week I will add her to my telephone,electricity bill and 401k.But we not planning to do the name change for now. would it be a problem?

Considering you only got married 4 days ago, not having the name changes will be less of a problem than not having them changed a few months from now. As I said, the USCIS doesn't expect newly-weds to have all of their ducks in a row at this moment in time-- but the more time that passes, the more they expect to see that co-mingling of lives.

No.

Nobody is forced to change their name, not even in marriage. A person has the legal right to keep their maiden name if they so wish and the USCIS has no jurisdiction to force such a request.

The spouse, taking on the married name is just one form of evidence to prove a bona-fide relationship-- there are many others.

His salary is over the poverty line for all household member , do I still need to show my wife earning or savings? can I include my earning? I am currently working on OPT as FTE and H1B being filled this year.

His salary is over the poverty line for all household member , do I still need to show my wife earning or savings? can I include my earning? I am currently working on OPT as FTE and H1B being filled this year.

09/11/2012 -(day 36)- Got message for Interview date on 10/15/2012
09/13/2012 -(day 38)- Hard copy of NOA for Interview

You can show yours and wife also.. To show proof that you both work ... But yes all those documents you listed you definitely need those from him if he's the co sponsor / signer

-Dec 2007: Met USC.

-Dec 2009: Got Engaged.

-Jan 2010: Fell out of Status.

-Oct 2010: Married USC.

-Feb 2012: Filed I-130/AOS

I-130/AOS Timeline

Day 0: 02/25/12: Mailed concurrent I-130/AOS Package to the Chicago Lockbox

Day 2: 02/27/12: Package arrived at the Chicago Lockbox.

Day 5: 03/01/12: Email acceptance confirmation received for Forms: I-130, I-485 & I-765.

Day 13: 03/09/12: NOA1s received for Forms: I-130, I-485 & I-765. Biometrics letter also received and scheduled for March 27th.

Day 24: 03/20/12: Email notification for RFE.

Day 27: 03/23/12: Hardcopy RFE received in the mail.

Day 31: 03/27/12: Biometrics completed.

Day 40: 04/05/12: Mailed off the RFE.

Day 44: 04/09/12: RFE Delivered.

Day 46: 04/11/12: USCIS received RFE and case updated online.

Day 55: 04/20/12: EAD approved!

Day 60: 04/25/12: Received 2nd "EAD in Production" Email.
